<br /> Mr. Whitlow suggested that Mr. Sercombe and Mr. French meet to develop an <br /> e appropriate course of action. Mr. Sercombe explained that the City Council <br /> had changed the vacation procedures to allow for a different process for <br /> unimproved alley and street vacations. He stated that the seven-day notice of <br /> the assessment as required by the new ordinance had not been performed. In <br /> addition, he stated that no agreement on the assessment had been reached by the <br /> City and the applicant. Mr. Sercombe stated that the suggestion to postpone <br /> the item was based on that failure to notify and the lack of any agreement on <br /> the assessment. With regard to the constuction schedule of the applicant, he <br /> recommended that the City Manager issue a temporary occupancy permit under <br /> Chapter 5 of the Eugene Code for the property to be vacated effective from <br /> September 1 through 15. He said the permit could be issued if the City and the <br /> applicant were able to agree on an assessment amount and that amount was paid by <br /> the applicant. He said staff hoped that this process will allow the vacation to <br /> proceed while still allowing the applicant to meet his construction schedule. He <br /> said Public Works and Planning Department staff will meet with the applicant <br /> after the council meeting. <br /> In response to a queston by Mr. Peting regarding the approval of the vacation, <br /> Mr. Sercombe stated that the council has not yet approved the vacation. He <br /> said his proposal was for an administrative permit which would allow the <br /> applicant to occupy the property prior to the council's consideration of the <br /> issue. He stated that there was usually no impediment to council approval of <br /> the vacation if the assessment issue was resolved. <br /> Councilor Ball entered the meeting at this time. <br /> e ORDINANCE FOR SECOND READING: <br /> IV. DOWNTOWN DEVELOPMENT DISTRICT CODE <br /> AMENDMENT <br /> Assistant City Manager David Whitlow introduced the agenda item. He explained <br /> that no staff report would be made since full discussion was held at the <br /> August 13 council meeting. He stated that staff was available to answer any <br /> questions of council. <br /> CB 2768--An ordinance concerning the Downtown Development <br /> District user fees; amending Sections 3.700, 3.705, <br /> 3.750, 3.755, and 3.760 of the Eugene Code, 1971; <br /> renumbering Section 3.745 of that code; adding new <br /> Sections 3.742, 3.743, 3.744, 3.745, 3.746, and 3.765 <br /> to that code; and providing an effective date. <br /> Mr. Obie moved, seconded by Ms. Wooten, that the bill be <br /> approved and given final passage. Roll call vote; the motion <br /> carried, 5:2; Councilors Obie, Wooten, Bascom, Holmer, and Schue <br /> voting aye; Councilors Ball and Hansen voting nay; and Councilor <br /> Ehrman abstaining.
