resignation is not required. Consequently, Ms. Bennett is a member of the
- commission now. She is one of the three at-large members. Mr. Hansen did not
think it is necessary to interview others for the position.
Ms. Wooten said the City Attorney indicated that losing an interest in the
downtown does not necessitate removal from the Downtown Commission. She said
it is only the Attorney's opinion, however, that a commissioner who loses a
specific downtown interest automatically becomes a commissioner at-large. She
thought other people should also be interviewed for the position.
Mr. Hansen said councilors should accept the opinion of a City Attorney even
if they do not like it.
Ms. Wooten summarized the amendments she and Mr. Hansen recommended. She said
they do not agree on whether people need to be interviewed for the new (4th)
at-large position.
Responding to questions from Ms. Ehrman, Mr. Hansen said the 5/4 composition
of the commission would be valid only through 1986. Ms. Wooten said she and
Mr. Hansen did not discuss having a councilor serve on the Downtown Commis-
sion. She was not interested in pursuing it.
Answering a question from Councilor Schue, Ms. Wooten said the status of an
at-large member of the commission would not be changed if the member opened a
business in the downtown.
- Ms. Wooten moved, seconded by Mr. Hansen, to direct the City
Manager to prepare amendments to the ordinance: 1) so that
those appointed to a downtown-interest position must resign if
they lose their downtown-interest status, and 2) so that the
composition of the Downtown Commission will be changed for 1986
only from 6 members with downtown interests to 5 members with
downtown interests and from 3 at-large members to 4 at-large
members.
Mr. Holmer moved, seconded by Ms. Ehrman, to amend the motion so
it would be divided. Roll call vote; the motion carried unani-
mously, 8:0.
Ms. Wooten withdrew her original motion.
Ms. Wooten moved, seconded by Mr. Hansen, to direct the City
Manager to prepare an amendment to the ordinance so that those
appointed to a specific downtown-interest position must resign
from the Downtown eommission if they lose their downtown-
interest status.
Mr. Hansen wondered if the proposed amendment would be effective immediately.
He was concerned about changing the current system if the changes would apply
to those appointed under another system. Ms. Wooten responded that her intent
was that the motion would be effective when the amendment is approved.
Answering questions from Ms. Bascom and Mr. Holmer, Ms. Wooten said her intent
e was that the motion should apply to all Downtown Commission members except
Ms. Bennett.
MINUTES--Eugene City Council October 28, 1985 Page 4
