CB 2858--An ordinance authorizing vacation of an 80-foot-wide - pUblic right-of-way on Moss Street from East 13th Avenue south 400.2 feet. Ms. Wooten moved, seconded by Mr. Hansen, that the bill be read the second time by council bill number only, with unanimous consent of the council, and that enactment be considered at this time. Roll call vote; the motion carried unanimously, 8:0. Council Bill 2858 was read the second time by council bill number only. Ms. Wooten moved, seconded by Mr. Hansen, that the bill be approved and given final passage. Roll call vote; all councilors present voting aye, the bill was declared passed (and became Ordinance No. 19362). . II. COUNeIL SUBCOMMITTEE RECOMMENDATION ON DOWNTOWN COMMISSION APPOINTMENTS Assistant City Manager Dave Whitlow introduced the agenda item. Council President Wooten said she and Vice President Hansen met with Elaine Stewart of the Eugene Development Department and Tim Sercombe, the City Attorney, and discussed the process for appointing members to the Downtown Commission. The enabling ordinance indicates that at least six members of the commission must have a specific interest in the downtown. The terms of two - members with specific interests and one at-large member will expire on December 31, 1985. Ms. Wooten said she and Mr. Hansen agreed on two recommendations to the council . The recommendations were: l. The council should amend the ordinance to indicate that a commission member appointed because of a specific interest in the downtown will no longer be eligible to serve if the specific interest is lost, and 2. The council should change the composition of the Downtown Commission for 1986 so that only 5 members must have a specific interest and 4 members are at-large. Ms. Wooten said the changes would permit Anne Bennett to continue serving in an at-large position through 1986 when her term will expire. Ms. Wooten said she and Mr. Hansen did not agree on whether Ms. Bennett would automatically fill the new at-large position. She said the City Attorney's opinion was that Ms. Bennett would automatically fill the new at-large position and interviews for it would not be necessary, but she thought other applicants should be interviewed for the position. Mr. Hansen said the eity Attorney said the law states that a member of the commission who is no longer employed, lives, or has an investment in the downtown automatically sustains the position until the term expires.
