<br /> CB 2858--An ordinance authorizing vacation of an 80-foot-wide <br />- pUblic right-of-way on Moss Street from East 13th <br /> Avenue south 400.2 feet. <br /> Ms. Wooten moved, seconded by Mr. Hansen, that the bill be read <br /> the second time by council bill number only, with unanimous <br /> consent of the council, and that enactment be considered at this <br /> time. Roll call vote; the motion carried unanimously, 8:0. <br /> Council Bill 2858 was read the second time by council bill number only. <br /> Ms. Wooten moved, seconded by Mr. Hansen, that the bill be <br /> approved and given final passage. Roll call vote; all <br /> councilors present voting aye, the bill was declared passed (and <br /> became Ordinance No. 19362). <br /> . <br /> II. COUNeIL SUBCOMMITTEE RECOMMENDATION ON DOWNTOWN COMMISSION APPOINTMENTS <br /> Assistant City Manager Dave Whitlow introduced the agenda item. <br /> Council President Wooten said she and Vice President Hansen met with Elaine <br /> Stewart of the Eugene Development Department and Tim Sercombe, the City <br /> Attorney, and discussed the process for appointing members to the Downtown <br /> Commission. The enabling ordinance indicates that at least six members of the <br /> commission must have a specific interest in the downtown. The terms of two <br />- members with specific interests and one at-large member will expire on <br /> December 31, 1985. <br /> Ms. Wooten said she and Mr. Hansen agreed on two recommendations to the <br /> council . The recommendations were: <br /> l. The council should amend the ordinance to indicate that a commission <br /> member appointed because of a specific interest in the downtown <br /> will no longer be eligible to serve if the specific interest is <br /> lost, and <br /> 2. The council should change the composition of the Downtown Commission <br /> for 1986 so that only 5 members must have a specific interest and 4 <br /> members are at-large. <br /> Ms. Wooten said the changes would permit Anne Bennett to continue serving in <br /> an at-large position through 1986 when her term will expire. Ms. Wooten said <br /> she and Mr. Hansen did not agree on whether Ms. Bennett would automatically <br /> fill the new at-large position. She said the City Attorney's opinion was that <br /> Ms. Bennett would automatically fill the new at-large position and interviews <br /> for it would not be necessary, but she thought other applicants should be <br /> interviewed for the position. <br /> Mr. Hansen said the eity Attorney said the law states that a member of the <br /> commission who is no longer employed, lives, or has an investment in the <br /> downtown automatically sustains the position until the term expires.
