Tree Commission Report <br /> <br />Mr. Boles said that the Committee on Infrastructure had received the Tree <br />Commission's report with regard to its attempt to reconcile points of <br />contention. He said the committee hopes to bring a set of alternatives to <br />the council. He asked councilors to study the material and be prepared to <br />provide direction at the meeting. <br /> <br />K. Home Rule <br /> <br />Mr. Boles said that the City Attorney's Office feels that the City's best <br />chance for a home rule test is in the area of the elections process. Mr. <br />Boles suggested that council craft a non-yes/no question for the community <br />to vote on, and that the City itself run the election. Mr. Boles wondered if <br />it might not be possible to present this to voters on the May ballot along <br />with the opening of Olive Street. <br /> <br />Mr. Rutan felt that taking this action on the home rule issue would <br />jeopardize the opening of Olive Street. He also expressed concern that it <br />was untimely to deal with this issue in light of the Eugene Decisions <br />process. <br /> <br />Mr. MacDonald noted phrasing the question in a non-yes/no fashion challenges <br />the State Constitution. He suggested that the County be contracted to do the <br />tabulation. <br /> <br />There was not enough support from council to pursue the issue at this time, <br />although all agreed that it is important and should be revisited. <br /> <br />Bill Gary, City Attorney's Office, said the City is prohibited from putting a <br />multiple choice question on the State ballot. That is why a separate <br />election must be held. <br /> <br />Mr. Boles asked the City Attorney to prepare a short report on home rule, <br />including implications, court decisions, and why it is important to have <br />local control. <br /> <br />II.
