<br />C. <br /> <br />Agenda Changes--Manager said Item X would be postponed to the April 5 <br />~eeting and consideration of the ordinance for a moratorium on panhandle ~ <br />lots would be substituted. <br /> <br />Mayor Keller indicated a request for testimony and noted the public <br />hearing had been held and closed at the Monday, March 27, meeting. It <br />was consensus of Council not to take further public hearing at this <br />~eeting. Mr. Bradley objected, and felt Council should allow the <br />speaker to address his concerns. · <br /> <br />Mr. Bradley moved, seconded by Mr. Hamel, to allow public <br />testimony. <br /> <br />Manager suggested it might be better to wait until that agenda item <br />was addressed. <br /> <br />Mr. Williams requested, seconded by Mr. Obie, to hold the item <br />over to Monday night, April 10, meeting. <br /> <br />In clarification, Stan Long, City Attorney, said Council had asked, <br />at its Monday night meeting, .for staff to prepare an ordinance for <br />this Wednesday meeting. He said there had been no hearing on this <br />particular ordinance and it is an agenda ite~. With request from <br />two Councilors, that item can be held over to the next Monday night <br />meeti ng. <br /> <br />Mr. Bradley moved, seconded by Mr. Obie, to have the item as a <br />public hearing for the April 10 meeting. <br /> <br />- <br /> <br />Mr. Obie said that was the only logical reason he would see for <br />holding the item over. Mr. Haws pointed out that would, in effe~t, <br />allow more people to ~ake applications for panhandle lots. There- <br />fore, he objected. He could not see there was anything to be <br />achieved hy holding a public hearing, and he was voting no. <br /> <br />Mr. Willians wondered if a public hearing were required on any ordi- <br />nance. Mr. Long said there is no such requirement that Council take <br />public testimony on each ordinance. He said options for Council were <br />to have a public hearing; not have a public hearing and accept written <br />testimony; or confine the scope of a public hearing. <br /> <br />A member of the audience asked for a point of order in that there were <br />two motions on the floor. Mr. Long clarified the one motion made to <br />allow the speaker to give public testiMOny at this meeting was not in <br />effect as that item had been removed from the agenda. <br /> <br />Vote was taken on the motion to allow public hearing, which was <br />defeated with Haws, Delay, Lieuallen, Williams, and Smith voting <br />no; Of)ie, -Hamel, and Bradley voting aye. <br /> <br />.- <br /> <br />3/29/78--3 <br /> <br />2..02.. <br />
