3. ACTION: An Ordinance Concerning Prohibited Uses and Special Use Limitations <br />in the /ND Nodal Development Overlay Zone in Downtown; and Amending Section 9.4280 of the <br />Eugene Code, 1971. (City File CA 12 -3) <br />MOTION AND VOTE: Councilor Poling, seconded by Councilor Pryor, moved to adopt Council Bill <br />No. 5087, an ordinance concerning prohibited uses and special use limitations in /ND Nodal <br />Development Overlay Zone in Downtown. PASSED: 6:2, Councilors Taylor and Brown opposed. <br />4. ACTION: An Ordinance Vacating the Portion of West 4th Alley Located Between <br />4th and 5th Avenues and Lincoln and Charnelton Streets (VRI 12 -3) <br />MOTION AND VOTE: Councilor Poling, seconded by Councilor Pryor, moved to adopt Council Bill <br />No. 5084, an ordinance vacating the portion of West 4 Alley located between 4 th and 5 th avenues and <br />Lincoln and Charnelton streets. FAILED: 3:5, Councilors Poling, Clark and Pryor in favor. <br />5. WORK SESSION: An Ordinance Concerning Urban Animal Keeping Standards; and <br />Amending Sections 9.2010, 9.2682, 9.2740, 9.3115, 9.3210, 9.3310, 9.3810, 9.39 10, and 9.5250 of <br />the Eugene Code, 1971, and Section 4.996 of that Code (City File CA 12 -2) <br />MOTION AND VOTE: Councilor Brown, seconded by Councilor Evans, moved to increase the <br />allowable number of miniature goats from two to three. PASSED: 5:3, Councilors Pryor, Taylor and <br />Poling opposed. <br />MOTION AND VOTE: Councilor Brown, seconded by Councilor Evans, moved to increase the <br />allowable number of bee hives from two to three. A friendly amendment reducing the setback to 5 ft., <br />provided that the hives are pointed toward the center of the owner's property, was accepted. <br />PASSED: 8:0. <br />MOTION AND VOTE: Councilor Brown, seconded by Councilor Syrett, moved to delete in section <br />"(4)(a) Animals Allowed" the phrase "any two of the following four categories of animals are allowed" <br />and replace it with City staffs original phrase "all of the following are allowed." FAILED: 2:6, <br />Councilors Syrett and Brown in favor. <br />After some discussion, there was general agreement that further discussion about licensing was needed. <br />MOTION AND VOTE: Councilor Clark, seconded by Councilor Pryor, moved to bring the ordinance <br />back to Council for a vote on February 20, 2013.
