<br />RESOLUTION NO. 4711 <br /> <br />A RESOLUTION ESTABLISHING HAZARDOUS <br />SUBSTANCE USER FEES FOR THE FISCAL YEAR <br />COMMENCING JULY 1,2002. <br /> <br />The City Council of the City of Eugene finds that: <br /> <br />A. Pursuant to Article VII of Amendment IV to the Eugene Charter of 1976 (the <br /> <br />"Amendment"), the City Council has previously adopted Resolution No. 4558 establishing fees to <br /> <br />be paid by hazardous substance users within the City for the 1998 fiscal year, Resolution No. 4587 <br /> <br />establishing fees to be paid by hazardous substance users within the City for the 1999 fiscal year, <br /> <br />Resolution No. 4634 establishing fees to be paid by hazardous substance users within the City for <br /> <br />the 2000 fiscal year, and Resolution No. 4667 establishing fees to be paid by hazardous substance <br /> <br />users within the City for the 2001 fiscal year. <br /> <br />B. In accordance with other requirements of the Amendment, the City Council, by <br /> <br />ordinance, has adopted the City's Hazardous Substance Tracking Instructions, which provide <br /> <br />guidance to hazardous substance users in completing and submitting the reports required by the <br /> <br />Amendment. <br /> <br />C. As a result of decisions of the Court of Appeals and Circuit Court in litigation <br /> <br />involving the Amendment, the City revised the method of calculating the hazardous substance user <br /> <br />fees. Section 3.694 of the Eugene Code, 1971, which was adopted on February 28, 2000, by <br /> <br />Ordinance No. 20189, imposes a fee upon hazardous substance users in an amount per FTE to be <br /> <br />established by resolution of the Council and paid annually, no later than May 1 of each year. <br /> <br />Resolution - 1 <br />
