S. T. Ford, Assistant Director of Oregon Civil Service Commission <br />was absent. <br /> <br />1. <br /> <br />Initiative Petitions ~ The City Recorder reported that <br />signatures on petitions circulated by the Future Power <br />place the matter on the ballot. <br /> <br />the City had, received 4640 certified <br />Committee. This is sufficient to <br /> <br />Council Bill No. 9097 - Ordering a special election for purpose of submitting to electors <br />of City on May 26, 1970, concurrently with regular primary election for Lane County and State of Oregon <br />amendments to the Charter of the city of Eugene proposed by initiative petition of the Electors, and <br />adopting the polling places and using the clerks provided and appointed by Lane County for said <br />election, and providing for all acts necessary for carrying on of said election, and declaring an. <br />emergency was submitted and read in full. <br /> <br />Mr. McDonald moved seconded <br />only with unanimous consent <br />second time by council bill <br /> <br />by Dr. Purdy that the bill be read the second time by council bill number <br />of the Council. All councilmen present voting aye, the bill was declared passed and numbered 15890. <br /> <br />The City Attorney explained that the City Council has thirty days to take action on an initiative <br />measure to put it on the ballot. Without this action, the measure would not go on the ballot for this <br />election. The report submitted by the Committee was intended to <br />be a foundation for discussion between the Council and the committee. Mr. Fraser read <br />the report, which recommended that the City declare itself a "public employer" to bring <br />itself under the State Public Employes Relations Board employe relations system. (PERB) <br />The PERB could assist in determining which empl~ye groups would be formally recognized <br />by the City,in fact finding and mediation if negotiations reached an impasse. The <br />committee recommended procedures to combine new city rules with PERB rules. It antici- <br />pated that a local ordinance would be enacted allowing for a procedural meshing and <br />ultimate resolution of the impasse procedure. Consideration should be given to: <br /> <br />a. Exchange of information on initial positions some weeks prior to opening <br />negotiations. These negotiations should begin several months prior to <br />deadline for resolutions in the City Budget. <br />b. If either party declares that negotiations are deaalocked within an <br />appropriate pe~iod of time, PERB would be asked to assist. A mediation <br />committee could be appointed, which would mnclude one private citizen <br />from Lane County. The committee could make non-binding recommendations <br />for settlement to parties. It could arbitrate the dispute and return a <br />decision before the end of two weeks. This decision would be binding <br />upon the City Manager and the employe bargaining agent. However, it would <br />not be binding upon the City Council. <br /> <br />At that juncture the ~ouncil would have the option of accepting or rejecting the arbitratmDs <br />decision on a yes or no basis. It would not have the option of approving or rejecting a de- <br />cision in part, unless the arbitrator requested the city council to make such/appropriate <br />decisions. <br /> <br />The Committee requested that (a) The Council adopt "in principle9 the interim report <br />with instructions to the committee to formalize its recommendations; (b) the City <br />Attorney or his staff be instructed'to provide drafting assistance and such further <br />legal assistance as might be required by the committee; (c) in event City Council <br />adopted the report in principle, the Council should go on record as opposed to the <br /> <br />present charter amendment proposed by the Eugene Firefighters Association, as an <br /> <br />2/24/70 - 1 <br /> <br />... <br />
