Certification Form <br />With each electronic materials accounting report, an electronic certification form (with an <br />electronic signature checkbox) executed by a responsible officer of the company is required. This <br />form (see Appendix B) attests that the information filed electronically is correct and complete to <br />the best of the company's knowledge, based on readily available information. The certification <br />form will also provide the name, telephone number and email address of the person completing <br />the report for the company. That person's name, telephone number and email address will not be <br />made public, but are for the City's use in the event that clarification or additional information is <br />needed. A faxed copy of the certification form is acceptable. <br />Trade Secret Forms <br />Provisions are made in the law for the reporting of trade secret chemicals when such status is <br />approved by the City's Fire Marshal. (See Appendix E, Trade Secret Reporting Forms and <br />Instructions.) <br />If you are claiming trade secrecy for one or more hazardous substances, you must submit: <br />1. A notarized report to the City's Fire Marshal submitted through Toxics Program <br />staff documenting that the substance is a trade secret as defined in the charter <br />amendment. This report must be on file prior to the procurement or <br />production of a trade secret hazardous substance. <br />2. A report to the Toxics Board submitted through Toxics Program staff <br />documenting that the above report has been filed with the City's Fire Marshal. If a <br />manufacturer is granted trade secret status for one substance only, materials <br />balance accounting is not required for that substance. However, the notarized <br />report to the City's Fire Marshal and the corresponding notification to the Toxics <br />Board are still required. <br />3. An aggregate materials accounting report if you claim two or more reportable <br />trade secret substances, entered as a single line item in the regular Hazardous <br />Substance Report. If trade secret status is approved, the trade secret substance or <br />substances are reported using a special designation number, using the same <br />process as for other reportable substances. If denied, there is provision for appeal <br />to the Toxics Board. <br />4. An independent auditor's report regarding precautions taken in trade secret <br />substance use and technological alternatives to trade secret substances. <br />Businesses interested in claiming trade secret status for substances should contact the Toxics <br />Program staff at 541- 682 -7118 for detailed reporting instructions. <br />Recordkeepin2 <br />A partial list of records that a facility may need to maintain for report generation and verification <br />during audits includes: <br />Previous years' reports <br />Engineering calculations and other notes <br />Purchase records from suppliers <br />-10- <br />
