On August 18, 2004, notice of the Planning Commission public hearing was mailed to the applicant, <br />owners and occupants of property within 300 feet of the subject property, the Laurel Hill Valley <br />Citizens neighborhood group, and other community organizations requesting such notice in accordance <br />with EC 9.7415(2). <br /> <br />Public Testimony <br />As of the date of this report, the Planning Division has received written public testimony in response to <br />the public hearing notice from the Laurel Hill Valley Citizens neighborhood association. Two letters <br />have been submitted, one in regard to the proposed refinement plan amendment, the second in regard <br />to the proposed zone change. The neighborhood organization testifies in one letter that the proposed <br />refinement plan amendment meets neither of the approval criteria. In the letter regarding the zone <br />change, the Laurel Hill Valley Citizens neighborhood association asserts that the proposed zone <br />change is inconsistent with the Laurel Hill Plan and should not be approved. Additional findings in the <br />staff evaluation below will address these concerns in greater depth. <br /> <br />Refinement Plan Amendment Evaluation <br />Based on the information currently available and the criteria contained in Section 9.8424 of the Eugene <br />Code (below in bold), staff makes the following preliminary evaluation: <br /> <br /> EC 9.8424(1) The refinement plan amendment is consistent with all of the following: <br /> (a) Statewide planning goals. <br /> <br /> Goal 1 - Citizen Involvement: To develop a citizen involvement program that insures the <br /> opportunity for citizens to be involved in all phases of the planning process. <br /> <br />The City has acknowledged provisions for citizen involvement which insure the opportunity for <br />citizens to be involved in all phases of the planning process and set out requirements for such <br />involvement. <br /> <br />The Laurel Hill Plan amendment is limited to a Land Use Map change within the East Laurel Hill area. <br />The plan amendment is subject to the Type IV public notification and hearing process beginning at EC <br />9.7410. <br /> <br />On June 21, 2004, Planning staff deemed the Laurel Hill Plan amendment application complete at the <br />applicant's request, and determined the proposal ready for processing. <br /> <br />On July 8 and August 31, 2004, referrals concerning the pending applications were sent to the Oregon <br />Department of Transportation (ODOT), and to the Laurel Hill Valley Citizens neighborhood <br />association and to City departments, consistent with EC 9.7415(2).
