Request <br />With this proposal, the application materials indicate that the owners propose to create a site <br />designated and zoned for commercial development. The following applications are evaluated in this <br />report: <br /> <br /> RA 04-1: Amend the Laurel Hill Plan Land Use diagram to change the designation of three <br /> parcels totaling 1.38 acres from Low-Density Residential to Commercial. <br /> <br /> Z 04-4: Change the Eugene Zoning Map to shift the base zone of 1.38 acres from R-l, Low- <br /> Density Residential to C-2, Community Commercial. <br /> <br />Overall Site Characteristics <br />The subject property is located on the northeast comer of the intersection of Laurel Hill Drive and <br />Moon Mountain Drive and slopes to the northeast toward the Interstate 5 freeway. Vegetation on the <br />site consists of grass areas and a mixture of predominantly deciduous trees as evident in site <br />photographs provided in the submitted application. Also as indicated in the applicant's materials, the <br />site consists of three parcels comprising approximately 1.38 acres of land. The property is traversed by <br />two public utility easements running in a southeast-northwest direction. A 100' wide easement for <br />Pacific Power & Light provides for location of high voltage power lines and a steel electrical support <br />standard at the southwest corr/er of the site. A 50' wide EWEB easement provides for location of <br />power lines supported on wood poles. The developable portion of the property is located between the <br />easements. <br /> <br />The site is otherwise vacant and also contains no historic resources. The property contains no <br />identified Statewide Goal 5 natural resources. Refer to the applicant's written material for additional <br />site information and data regarding surrounding land uses. <br /> <br />Type IV Refinement Plan Amendment and Concurrent Zone Change Process <br />The amendment to the Laurel Hill Plan is limited to a map change of the subject site. The Type IV <br />application process provides for a quasi-judicial review by the Planning Commission and City Council <br />for applications that involve a specific site. A refinement plan amendment requires a public hearing <br />before Planning Commission and a second public hearing before City Council. Review of a proposed <br />refinement plan amendment is subject to the criteria listed in EC 9.8421. <br /> <br />The Furtick/Larson zone change application for the same parcel is being processed concurrent with the <br />Laurel Hill Plan map amendment and thus will follow the Type IV procedures as well. Review of a <br />zone change is subject to the criteria listed in EC 9.8865. Approval of the zone change is dependent <br />upon approval of the concurrent Laurel Hill Plan amendment request. <br /> <br />Application Referrals and Public Hearing Notice <br />The applications were submitted to the City of Eugene on January 20, 2004. On February 17, 2004, <br />the City informed the applicant of missing or incomplete materials. On June 21, 2004, the applicant <br />submitted additional materials and the City deemed the applications complete, at the applicant's <br />request. <br /> <br />On July 8 and August 31, 2004, referrals concerning the pending applications were sent to the Oregon <br />Department of Transportation (ODOT), and to the Laurel Hill Valley Citizens neighborhood <br />association and to City departments, consistent with EC 9.7415(2). On July 2, 2004, the City mailed <br />notice of the proposed plan amendments to the Department of Land Conservation and Development, as <br />required by EC 9.7415(1) and in accordance with State statutes. <br /> <br />Planning Division Staff Report 7 September 2004 Page 2 of 13 <br />(RA 04-1 and Z 04-4) <br /> <br /> <br />
