As the holder of the public road approach permit, the City of Eugene shall ensure the <br /> construction of the Project improvements, within the timelines and according to the <br /> specifications set out in Exhibit "A". <br /> <br />4. This Agreement shall begin on the date all required signatures are obtained. This <br /> Agreement shall remain in effect, and will be a condition of the ODOT Construction <br /> Permit for the public approach and of the Permit to Operate, Maintain and Use an <br /> Approach for this Project. <br /> <br />5. ODOT, the City of Eugene and the City of Springfield will be responsible for maintaining <br /> the facilities under their respective jurisdictions. <br /> <br />6. .This Agreement applies to the land parcels identified in Recital 5 as they are currently <br /> zoned and contemplated for development as identified by Exhibit "A" page 5'. If the land <br /> parcels subject to this Agreement develop in a manner that deteriorates the volume to <br /> capacity ratio at the Judkins Point (Glenwood) Interchange to a point below that <br /> anticipated by the phasing identified by Exhibit "A" page 5, then the City of Eugene, City <br /> of Springfield and ODOT shall review the development proposal and will amend the <br /> public road approach permit to address the changed traffic impacts. This review and <br /> amendment process must occur prior to any City of Eugene land use approvals for <br /> development or plan/zone changes not identified in Exhibit A of this agreement. <br /> <br /> ODOT OBLIGATIONS <br /> <br />1. Execution of this Agreement by ODOT constitutes ODOT's agreement with the <br /> mitigation (Project) n~ssary to issue a public road approach permit pursuant to OAR <br /> 734-051-0010 et. seq. A construction permit for a public road approach at Brackenfern <br /> shall be issued to the City of Eugene upon execution of this Agreement by all parties. <br /> <br />2. ODOT shall review and apProve all design and construction specifications, traffic control <br /> plans, lengths of turn lanes as described in Exhibit "A'. <br /> <br />3. ODOT shall review the traffic signal warrant analysis provided by the City of Eugene to <br /> determine if traffic signalization is warranted at the location where a signal is proposed in <br /> Exhibit "A". <br /> <br />4. Upon completion to the satisfaction of ODOT of Stage Two mitigation of the Project as <br /> shown in Exhibit A., ODOT will issue a P¢iiiiit to Operate, Maintain and Use an <br /> Approach to the City of EUgene at Brackenfern located at the intemx~ion of Glenwood <br /> Blvd.fMoon Mountain Dr./Glenwood Dr. and the Brackenfem Extension as shown on <br /> page 7 of Exhibit A, Drawing 2. <br /> <br /> II-B-90 <br /> <br /> <br />
