Upon completion of Project and at its own expense, ODOT shall maintain the highways and other facilities that are under ODOT jurisdiction. 6. ODOT will process an approach road application for a public road connection for Moon Mountain Drive located at the intersection of Glenwood Blvd./Moon Mountain Dr./Glenwood Dr. and the Bmckenfem Extension as shown on page 9 of Exhibit A, Drawing 4 according to the provisions of this agreement when submitted by the City of Eugene. CITY OF EUGENE OBLIGATIONS 1. The City of Eugene shall ensure the provision of the Project improvements, within the timelines set out in the Mitigation Stages and Development Phases of Exhibit "A", and according to the specifications set out in Exhibit "A". Except for permits necessary to proceed with related transportation improvements or other pre-development activity, such as grading/fill or utility extensions, the City of Eugene shall not issue building permits for residential or commercial development prior to the completion of each stage of transportation improvements identified for the specific phase of Project development. 2. The City of Eugene acknowledges that this Agreement is consistent with its comprehensive plan, including its Transportation System Plan. 3. The City of Eugene shall be responsible for obtaining the required permits to perform work upon ODOT right of way within Eugene City limits. 4. The City of Eugene shall work with the private landowners to ensure that all requirements of this Agreement, the Construction Permit for a public road approach, and any other ODOT permits are met, including, but not limited to, relocation or adjustment of any conflicting utility-facilities located on ODOT fight-of-way; all necessary preliminary en~neering and design work required to produce plans and specifications; all necessary fight-of-way acquisition or easements; and all project manager services for administration of the construction work. 5. The City of Eugene agrees that all right-of-way acquisition or easement activities on the State highway system shall bo in accord with the Uniform Relocation Assistance & Real Property Acquisition Policy Act of 1970, as amended; ORS 281.060 and ORS Chapter · 35; FHWA Federal Aid Policy Guide; ODOT's Right-of-Way Manual; and tho Code of Federal Regulations, Title 23, Part 710, and Title 49, Part 24. Ifthe City of Eugene uses a consultant to obtain fight-of-way on the State highway system, the City of Eugene's 'consultant selection must be approved by ODOT's Region.3 Right of Way office prior to work being performed. Certification of right-of-way acquisition work must be made by the City of Eugene (or on behalf of its consultant) doing th work. The cextification form II-B-91
