City of Eugene / City of Springfield / State of Oregon Page 5 of 9 <br />Agreement No. 19131 <br /> <br /> shall be muted through ODOT's Region 3 Right of Way office for co-signature and <br /> possible audit. <br /> <br />6. The City of Eugene shall be responsible for providing the required traffic signal warrant <br /> analysis, design and construction for the signal within the City of Eugene proposed in <br /> Exhibit "A". This analysis, design and construction shall be subject to ODOT's approval. <br /> <br />7. The City of Eugene must obtain ODOT's approval for travel lane configuration, any <br /> applicable storage requirements associated with turn lanes, any necessarY traffic control <br /> devices or modifications to existing traffic control devices, and design and construction <br /> specifications on ODOT-managed facilities. <br /> <br />8. Upon completion of the Project and at its own exPense, the City of Eugene shall maintain <br /> the streets that are under City of Eugene jurisdiction. <br /> <br />9. The City of Eugene shall require contractors working on ODOT property within the <br /> Eugene City limits to keep in effect during the temi of the construction contract, <br /> Comprehensive or Commercial General Liability Insurance covering bodily injury and <br /> property damage. This insurance shall include personal injury coverage, contractual <br /> liability coverage for the indemnity provided under this Agreement, and <br /> products/completed operations liability. Combined single limit per occurrence shall not <br /> be less than $1,000,000 or the equivalent. Each annual aggregate limit shall not be less <br /> than $2,000,000, when applicable. <br /> <br /> The liability coverage required for performance of this Agreement shall include the State <br /> of Oregon, Transportation Commission and its members, the Depa~iment of <br /> Transportation, and its officers and employees, as additional insureds. <br /> <br /> Before ~trt of construction, the City of Eugene shall furnish to ODOT a Certificate of <br /> Insurance for the limits set out above, which is to be in force and applicable to the project. <br /> <br /> The in~qurance coverage shall not be amended, altered, modified, or canceled insofar as <br /> the coverage contemplated herein is concerned without at least 30 days prior written <br /> notice to ODOT. <br /> <br /> 10. The City of Eugene agrees to initiate the process to convey land to ODOT described as <br /> City of Eugene Deed Easement R-2540R-99035801, shown on ODOT fight-of-way map <br /> number IA-16-14, and on page 10 of Exhibit A, Drawing 5 prior to commencing any <br /> work on Stago 2 of the'Project as describe on page 3 of Exhibit A. <br /> <br /> 11. The City of Eugene will work with pwperty owners to obtain a correction deed to <br /> eliminate an access control line to allow for a mad. connection for Moon Mountain Drive <br /> and will apply for a Public Road Approach Permit at the future intersection of Glenwood <br /> Blvd./Moon Mountain Dr./Glenwood Dr. and the Brackenfern Extension as shown on <br /> <br /> II-B-92 <br /> <br /> <br />
