Exhibit A <br /> <br /> Findings for RA 04-1 and Z 04-4 <br /> <br />Refinement Plan Amendments Eugene Code Section 9.8424 requires that the following criteria (in <br />bold and italic) be applied to a Refinement Plan amendment. <br /> <br />EC 9. 8424(1)(a) The refinement plan amendment is consistent with Statewide planning goals. <br /> <br /> Goal 1 - Citizen Involvement: To develop a citizen involvement program that insures the <br /> opportunity for citizens to be involved in all phases of the planning process. <br /> <br />The City has acknowledged provisions for citizen involvement which insure the opportunity for <br />citizens to be involved in all phases of the planning process and set out requirements for such <br />involvement. <br /> <br />The Laurel Hill Plan amendment is limited to a Land Use Map change within the East Laurel Hill <br />area. The plan amendment is subject to the Type IV public notification and hearing process <br />beginning at EC 9.7410. <br /> <br />On June 21, 2004, the Planning Division deemed the Laurel Hill Plan amendment application <br />complete at the applicant's request, and determined the proposal ready for processing. <br /> <br />On July 8 and August 31, 2004, referrals concerning the pending applications were sent to the Oregon <br />Department of Transportation (ODOT), and to the Laurel Hill Valley Citizens neighborhood <br />association and to City departments, consistent with EC 9.7415(2). On July 2, 2004, the City mailed <br />notice of the proposed plan amendments to the Department of Land Conservation and Development, <br />as required by EC 9.7415 (1) and in accordance with State statutes. <br /> <br />On August 18, 2004, notice of the Planning Commission public hearing was mailed to the applicant, <br />owners and occupants of property within 300 feet of the subject property, the Laurel Hill Valley <br />Citizens neighborhood group, and other community organizations requesting such notice in <br />accordance with EC 9.7415(2). <br /> <br />Following a recommendation from the Planning Commission, the City Council held a duly noticed <br />public hearing on the record to consider approval, modification, or denial of the amendment. These <br />processes afford ample opportunity for citizen involvement consistent with Goal 1. <br /> <br />Therefore, the amendment is consistent with Statewide Planning Goal 1. <br /> <br /> Goal 2 - Land Use Planning: To estabfish a land use planningprocess andpoficyframework <br /> as a basis for all decisions and actions related to use of land and to assure an adequate <br /> factual base for such decisions and actions. <br /> <br />The record shows that there is an adequate factual base to support the recommendation regarding this <br />amendment as Goal 2 requires. Further, the Goal 2 coordination requirement is met.
