ADMINISTRATIVE ORDER NO. 53- 14 -05 -F <br />of the <br />City Manager of the City of Eugene <br />AMENDMENT OF THE PARKING FEE SCHEDULE AND REPEAL OF <br />ADMINISTRATIVE ORDER NO. 53-12-02-F. <br />The City Manager of the City of Eugene finds as follows: <br />A. Section 2.020 of the Eugene Code, 1971 (EC), authorizes the City Manager to <br />determine and set fees and charges to be imposed by the City for services, goods, use of <br />municipal property, and licenses and permits. In addition, EC 5.040 authorizes the City Manager <br />to establish parking areas, time limitations, form of permissible parking and fees therefore. EC <br />5:285(5) provides that charges for off - street parking facilities be established by administrative <br />action of the City Manager. EC 5.335(2) authorizes the City Manager to designate on- street <br />parking meter zones, hourly rates and time limitations by administrative action, subject to the <br />maximum charges for on- street parking meter rates in subsection EC 5.335(1). <br />B. On June 11, 2014, I issued Administrative Order No. 53 -14 -05 proposing the <br />amendment of the Parking Fee Schedule that had been established by Administrative Order No. <br />53- 12 -02 -F on September 21, 2012. The amendments were proposed in order to more accurately <br />recover the City's costs of parking enforcement. <br />C. A copy of the Notice containing the current and proposed fees was provided to the <br />Mayor and City Councilors, made available to persons who had requested such notice, and made <br />available for inspection by interested persons at Parking Services, Planning & Development <br />Department, 99 West 10th Avenue, Eugene, Oregon 97401, during normal business hours. In <br />addition, on June 19, 2014, a copy of the Notice attached as Exhibit A to Administrative Order <br />No. 53 -14 -05 was posted at two locations at City Hall, and a copy of the Notice attached as <br />Exhibit B to Administrative Order No. 53 -14 -05 (which contained those fees proposed to be <br />$250 or more) was published in the Register -Guard newspaper. The Notice provided that written <br />comments would be received for a period of 15 days from the date of posting. <br />D. Fifty -two comments were submitted in response to the parking fee amendments. <br />A summary of the comments is set out below, followed by my response to the comments. <br />Comments from those unopposed to the amendments Six people submitted <br />comments stating that they were not opposed to the rate increases. <br />Response The City appreciates this feedback. No changes to the fee <br />schedule are necessary as a result of these comments. <br />Comments concerning delaying the implementation date Four people <br />indicated that they would prefer that the City delay the rate increases for reasons <br />Administrative Order - Page 1 of 4 <br />
