(1) Is consistent with applicable statewide planning goals as adopted by the Land <br /> Conservation and Development Commission. <br /> <br /> (2) Is consistent with applicable provisions of the Metro Plan and applicable adopted <br /> refinement plans. <br /> <br /> (3) In the case of establishm, ent ora special area zone, is consistent with EC 9.3020 Criteria <br /> _for establishment of an S Special 21rea Zone, <br /> <br />Planning staff concludes that the proposed code amendment complies with the applicable approval <br />criteria, finding that neither the Statewide Planning Goals nor applicable adopted plans include <br />provisions that are directly applicable to the proposed code amendment. Moreover EC 9.8065(3) is <br />not applicable. However, the applicant's written statement includes an evaluation of the proposed <br />S-HK Zone for consistency with the code amendment approval criteria. Because the provisions of <br />the proposed S-HK Zone will not be codified, these findings of Compliance with the code <br />amendment criteria are not required. Staff findings and 'conclusions for the proposed code <br />amendment will be incorporated in Exhibit B of the draft ordinance. <br /> <br />Zone Change: The proposed zone change would apply the proposed S-HK Historic Kaufman <br />House Special Area zone to the Kaufinan House property. Approval of a zone change application <br />shall not be approved unless it meets all of the following criteria from EC 9.8865: <br /> <br /> (1) The proposed change is consistent with applicable provisions of the Metro Plan. The <br /> written text of the Metro Plan shall take precedence over the Metro Plan diagram where <br /> apparent conflicts or inconsistencies exist. <br /> <br /> (2) The proposed zone change is consistent with applicable adopted refinernent plans. In the <br /> event of inconsistencies between these plans and the Metro Plan, the Metro'Plan <br /> controls. <br /> <br /> (3) The uses and density that will be allowed by the proposed zoning in the location of the <br /> proposed change can be served through the orderly extension of key urban facilities and <br /> services. <br /> <br /> (4) The proposed zone change is consistent with the applicable siting requirements set out <br /> for the specific zone in:. <br /> <br /> (a) EC 9.2150 Commercial Zone Siting Requirements. <br /> (b) EC 9.2430 Industrial Zone Siting Requirements. <br /> (c) EC 9. 2510 Natural Resource Zone Siting Requirements. <br /> (d) EC 9.2610 Park~ Recreation, and Open Space SitingRequirements. <br /> (e) EC 9. 2681 Public Land Zone Siting Requirements~ <br /> EC 9.2 735 Residential Zone Siting Requirements. <br /> (g) EC 9.3105 S-CN Chase Node Special.drea Zone Siting Requirements; <br /> (h) EC 9.3205 S-DW Downtown Westside Special ~lrea Zone Siting <br /> .Requirements. <br /> (i) EC 9. 3305 S-E Elmira Road Special ~lrea Zone Siting Requirements. <br /> 0') EC 9. 3 705 S-RP Riverfront Park Special ~trea Zone Siting Requirements. <br /> EC 9.3805 S-RN Royal Node Special ~lrea Zone Siting Requirements. <br /> <br /> 5 <br /> 5 <br /> <br /> <br />
