(4) The application of the zone to the properties proposed for inclusion in the S Special Area · <br /> zone and the required provisions of a special area zone ordinance are consistent with the <br /> criteria required for approval of a'zone change, according to EC 9.8865 Zone Change <br /> .4pproval Criteria. " <br /> <br /> The app!ieant's submittal addresses compliance with each of the above criteria. Planning staff <br /> concurs with the applicant's findings and conclusions and will incorporate those findings in <br /> Exhibit B of the draft ordinance. <br /> <br /> Planning staff would note that the City's application proposes to codify the provisions of'the <br /> proposed S-HK zone and, accordingly, includes and evaluation of the zone for compliance with the <br /> code amendment criteria at EC 9.8065. Although Planning staff concurs with-.the applicant's <br /> analysis, the criteria are not applicable to establishment of the zone. The City's practice pertaining <br /> to the. adoption of site-specific regulations for historic properties has been to keep such regulations <br /> out of the City's code. The updated land use code provides that site-specific S-H'Historic Special <br /> Area Zones may be established by ordinance and need not be codified as is proposed in the City's <br /> application materials. The draft ordinance prOvided in Attachment A-1 establishes the Proposed <br /> zone without codification, and is consistent with past practice. <br /> <br /> The provisions of the proposed S-HK Zone have been further refined and clarified in the draft <br /> ordinance based on questions and suggestions from Land Use Management, Historic Preservation, <br /> and Facilities staff, the City Attorney's Office, and conversations with Jefferson-Westside <br />· Neighbors representatives. Planning staff recommends that the Planning Commission forward a <br /> recommendation to the City Council in support of the draft ordinance in its current form, allowing <br /> for any further refinements that may be necessary to be considered by the City Council. <br /> <br /> Code Amendment: The proposed code amendment will establish a zone change criterion that <br /> references the siting requirements in uncodified site-specific S-H HiStoric Special Area Zones. It <br /> will ensure that site-specific S-H Historic Special Area Zones are applied only to the designated <br /> site. This means that only the Kaufinan House would qualify for the site-specific S-H Historic <br /> Kaufman House Special Area Zone. <br /> <br /> The zone change approval criteria at EC 9.8865 provide that a proposed zone change shall be <br /> consistent with applicable siting requirements, with reference to the' code sections corresponding <br /> with the siting requirements in each zone set forth in the land use code. However, the zone change <br /> approval criteria make no reference to the siting requirements for uncodified Site-specific S-H <br /> Historic Special Area Zones. The proposed code amendment will amend Eugene. Code section <br />· 9.8865 to include this reference. Specifically, the following addition to EC 9.8865(4) is proposed <br /> in the draft ordinance within Attachment A- 1: <br /> <br /> (p) An uncodOqed ordinance establishing a site-specific S-H Historic <br /> Special Area Zone, a copy of which is maintained at the city's planning <br /> and development department. <br /> <br /> The Eugene Code provides that if the City Council elects to act, it may, by ordinance, adopt an <br /> amendment to this land use code that complies with the following criteria from EC 9.8065: <br /> <br /> 4 4 <br /> <br /> <br />
