(b)Where the base zone is C-1, C-2, C-3, or GO, the /TD standards in EC
<br />9.4530 shall apply, except that the minimum floor area ratio (FAR) shall
<br />be 1.0 FAR (1.0 square feet of floor area to 1 square foot of the
<br />development site).
<br />(c)Where the base zone is E-1, E-2, I-2, or I-3, the /TD standards in EC
<br />9.4530shall apply, except that the minimum floor area ratio (FAR) shall
<br />be .40 FAR (.40 square feet of floor area to 1 square foot of the
<br />development site).
<br />Section 38.
<br />Subsection (1) of Section 9.4640of the Eugene Code, 1971, isamended to
<br />provide as follows:
<br />9.4640Annexation and/or Annexation Agreements.
<br />(1)
<br />Annexation of the entire development site, or execution of a consent to
<br />annexation agreement is required prior to any of the following actions:
<br />(a)Any zone change or planned unit development approval if the
<br />development potential of the existing lot(s) would increase, or the
<br />proposed or allowable uses will generate, singly or in the aggregate, a
<br />direct additional need for key urban facilities and services.
<br />(b)Approval of any new dwelling unit(s), commercial or employment and
<br />industrial development.
<br />(c)Approval of an expansion of an existing commercial or employment and
<br />industrial development if the proposed use will generate, singly or in the
<br />aggregate, a direct additional need for key urban facilities and services
<br />provided by the city.
<br />Section 39.
<br />Subsections(3)(a), (4)(a)1., (5)(a)1., (6)(c)2., (7)(b), (7)(d), and (7)(e)of
<br />Section 9.5750of the Eugene Code,1971, areamended to provide as follows:
<br />9.5750Telecommunication Devices-Siting Requirements and Procedures.
<br />(3)Collocation of Additional Antennas on Existing Transmission Tower.
<br />(a)Permitted Use. Collocation of an additional antenna on an existing
<br />transmission tower shall be considered an outright permitted use if
<br />property is zoned GO, PL, S, C-2, C-3, E-1, E-2,I-2, or I-3 or if the
<br />transmission tower is in any other zone and the city specifically
<br />approved, as part of a prior land use process authorizing the
<br />transmission tower, collocation of additional antennas.
<br />(4)Collocation of Antennas on Existing Buildings, Light or Utility Poles, and
<br />Water Towers.
<br /> In addition to collocation on a transmission tower, an
<br />antenna may be collocated on existing buildings, light or utility poles, and
<br />water towers.
<br />(a)Permitted Use. Such collocation on a building, light or utility pole, or
<br />water tower, shall be considered an outright permitted use provided that
<br />the antennas and ancillary facilities comply with the standards contained
<br />in EC 9.5750 Telecommunications Devices-Siting Requirements and
<br />Procedures, the color of the antennas blends in with the existing
<br />structure and surroundings, and one of the following is met:
