elevation data has been provided as required in subsections 9.6707(1) or (2), <br />the following provisions are required: <br />(b)Nonresidential Construction. New construction and substantial <br />improvement of any commercial,employment andindustrialor other <br />nonresidential structure shall either have the lowest floor, including <br />basement, elevated to the level of the base flood elevation; or, together <br />with attendant utility and sanitary facilities, shall: <br />1.Be flood proofed so that below the base flood level the structure is <br />watertight with walls substantially impermeable to the passage of <br />water; <br />2.Have structural components capable of resisting hydrostatic and <br />hydrodynamic loads and effects of buoyancy; <br />3.Be certified by a registered professional engineer or architect that <br />the design and methods of construction are in accordance with <br />accepted standards of practice for meeting provisions of this <br />subsection based on their development and/or review of the <br />structural design, specifications and plans. Such certifications <br />shall be provided to the building official as required in section <br />9.6707. <br />4.Nonresidential structures that are elevated, not floodproofed, must <br />meet the same standards for space below the lowest floor as <br />described in subparagraph (2)(a)2. of this section. <br />5.Applicants floodproofing nonresidential buildings shall be notified <br />that flood insurance premiums will be based on rates that are one <br />foot below the floodproofed level (e.g. a building constructed to <br />the base flood level will be rated as one foot below that level). <br />Section 54. <br />Subsection (8)(d) of Section 9.6725of the Eugene Code, 1971, is amended <br />to provide as follows: <br />9.6725Outdoor Lighting Standards. <br />(8)Creation of Outdoor Lighting Classifications. <br />To ensure appropriate <br />lighting while minimizing its undesirable side effects, the zones established <br />elsewhere in this land use code are consolidated into lighting zones, as <br />follows: <br />(d)High Ambient Light Areas (O-4) shall be permitted inareas planned or <br />developed for a mix of uses and a high level of nighttime activity. This <br />includes areas in the broad zone category of commercial, except for C- <br />1, and areas in the broad zone category of employment and industrial. <br />It also includes portions of colleges and universities, high schools, the <br />fairgrounds, and other areas zoned PL determined by the planning <br />director to have a high level of nighttime activity. Areas determined not <br />to have a high level of nighttime activity that are zoned PL shall be <br />considered Low Ambient Light Areas (O-2). <br />Section 55. <br />Subsection (2) of Section 9.6730of the Eugene Code, 1971, is amended to <br />provide as follows: <br />Ordinance -Page 40of 48 <br />
