fromthesubjectpropertyat92PMpeakhourtrips.Thistripcapisbasedonadetailedtraffic <br />analysisbythepropertyownerdatedApril14,2014,whichshowsthattheappropriate <br />mobilitystandardisachievedatalltrafficstudyareaintersectionsifaPMpeakhourtripcap <br />of92isassumed.Theresultisthattheamountoftrafficprojectedtobegeneratedforthe <br />subjectpropertywiththeproposedplandesignationislimitedtotheamountoftraffic <br />generatedbeforetheintersectionswouldpotentiallybesignificantlyimpacted. <br />Byimposingatripcapof92onthepropertysubjecttotheplandesignationchange,thetraffic <br />generatedfromthesubjectpropertyaftertheamendmentscannotexceedthepointinwhich <br />theperformanceoftransportationfacilitieswouldpotentiallybesignificantlyimpacted.The <br />tripcapisanenforceable,ongoingrequirementthatwilldemonstrablylimittrafficgeneration <br />forthesubjectpropertybypreventingtrafficgenerationbeyondthatwhichwouldpotentially <br />createasignificantimpact.Thetripcapisenforceableandongoingbecauseitwillbe <br />monitoredfortheareasoftheamendmentseachtimeabuildingpermitisreceivedbythe <br />City.Untilthecapislifted,thepropertywithinthesubjectareacanonlydevelopwithause <br />thatgenerates92orlessPMpeaktrips.Thetripcapandthemannerinwhichitcanbe <br />modifiedwillberecordedwiththeredesignationordinanceadoptingtheplanamendment. <br />Thus,inaccordancewithOAR6600120060(1)(c),theproposedtripcapcanbeconsidered <br />whendeterminingwhetheraproposedamendmentwillsignificantlyaffectanexistingor <br />plannedtransportationfacility.Becauseimposingatripcapof92preventstheproposed <br />amendmentfromcreatinganyadditionaltrafficgenerationfromthesubjectpropertybeyond <br />thepointbeforetheperformanceoftransportationfacilitieswouldpotentiallybesignificantly <br />impacted,thetripcapcompletelyeliminatesthepotentialsignificanteffectofthe <br />amendmentand,therefore,noadditionalTPRanalysisisneeded. <br />Withatripcapthatpreventstripgenerationbeyond92PMpeaktripstheproposed <br />thetripcaprequiresa <br />amendmentcomplieswiththeTPR;anymodificationorliftingof <br />separatedemonstrationofTPRcompliance.Thus,priortomodifyingorliftingofthetripcap, <br />ananalysismustbedonetodeterminewhether,withoutthetripcaporwithamodifiedtrip <br />cap,anyexistingorplannedtransportationfacilitieswillbesignificantlyaffectedbythe <br />amendment.Iftheanalysisshowsthatthereisasignificanteffectfromtheamendment,the <br />tripcapcouldbeliftedormodifiedonlyifoneormoreofthemitigationmeasuressetforthin <br />OAR6600120060(2)isadopted.Thisanalysisand,ifnecessary,adoptionofmitigation <br />measures,couldoccuraspartoftheŝƚLJ͛ƐupdatetoitsTransportationSystemPlan(TSP)or <br />couldoccurthroughaseparateprocess.WhetherdonethroughtheTSPadoptionprocessor <br />aseparateapplication,thetripcapmodificationprocesswillincludenoticeandan <br />opportunityforpublicparticipationandademonstrationofcompliancewiththeTPR. <br />Assuch,perOAR6600120060(3)thepotentialsignificanteffectoftheplandesignation <br />amendmentontheIrvingRd/Eaglespropertyiseliminatedbecausetheamendmentincludes <br />atripcapthatisanenforceable,ongoingrequirementthatlimitstrafficgenerationtothe <br />pointbeforetheperformanceoftransportationfacilitieswouldpotentiallybesignificantly <br />impacted;thereforetheproposedplanamendmentisconsistentwithGoal12. <br />Basedontheabovefindings,theamendmentsandzonechangesareconsistentwithStatewide <br />PlanningGoal12. <br />Findings13 <br />
