4. URBAN GROWTH BOUNDARY "SWAPS" <br /> <br /> Requirements for establishment and change of urban growth boundaries are detailed in <br /> Statewide Planning Goal 14, Urbanization, Statewide Planning Goal 2, Land Use <br /> Planning, and ORS 197.298, Priority of land to be included within urban growth <br /> boundary. These requirements assume that the change to the UGB is an expansion; there <br /> is nothing in the goals or the statutes that would streamline the process for an urban <br /> growth boundary change based on a "no-net-gain swap," brings some land into the urban <br /> growth boundary while removing other land from the boundary. The Goal 14 Working <br /> Group, convened by DLCD in 1999, expressed interest in streamlining the process for a <br /> UGB swap, but the work of this group was put on hold following the results of the <br /> election on Ballot Measure 7. A streamlined process for UGB "swaps" would allow a <br /> city to fine-tune its urban growth boundary to reflect new information and opportunities <br /> since the urban growth boundary was established. <br /> <br /> Recommendation: <br /> <br /> 1. Support legislation that would allow modification of requirements and a <br /> streamlined process for urban growth boundary amendments that would result <br /> in a "no-net-gain swap." <br /> <br /> 5. ANNEXATION <br /> <br /> The Eugene-Springfield Metro Plan establishes an urban growth boundary and envisions <br /> that all land within the urban growth boundary ultimately will be annexed to a city and <br /> provided with the required urban services. Annexations to Eugene are processed by the <br /> Lane County Boundary Commission. In past legislative sessions, legislation has been <br /> introduced to eliminate the Lane County boundary commissions and to eliminate or <br /> weaken existing methods of annexation. <br /> <br /> State law currently requires that withdrawals of annexed territory from special service <br /> districts be processed by a city separately from Boundary Commission action on the <br /> annexation request, necessitating a separate city hearing and action following Boundary <br /> Commission approval of an annexation. <br /> <br /> Recommendations: <br /> <br /> 1. Oppose legislation that eliminates the Lane County Boundary Commission or <br /> eliminates or weakens existing methods of annexation. <br /> <br /> 2. Support legislation to allow withdrawal of territory from special service districts <br /> to be processed by the Boundary Commission concurrent with its action on <br /> annexation requests. <br /> <br /> 6.
