I1 Maintenance: Parking and loading facilities and landscaping shall be continuously <br /> maintained in good condition and appearance. Whenever t~ecessary, surfiaeing, lighting, <br /> curbing, marlcings a~d plantings shall be repaired or replaced with new materials, and <br /> drainage structures shall be clea!~ed or replaced in order toinsure continued compliance wifla <br /> the provisions of Section 7.7. Failure to maintain parking facilities properly shall be <br /> considered a violation office Zoning Bylaw. <br /> <br /> 7,7.4,12 ~elieJ'.[kom de.s. iga requirement, v: The Board may~ upon advice of the Plamaing <br /> Board, grant relief fi'om the design standards contained in subsection 7.7.4.1 where the <br /> varia[ion in ~he sta~dards can be supported by a study prepared by a qualified parking <br /> consultant, end where the Board finds that' the desired relief may be granted without <br /> substantial detriment to the neighborhood and without derogating fi'om the intent and <br /> purpose of this Bylaw. <br /> <br />7.8 Personal Wireless Communications FaciLity <br /> <br /> 7.8.1 Purpose andlnrent: The purpose of this Section is to establish a district within <br /> the Town in which personal wireless commtmication facilities may bc provided, to regulate <br /> their impacts and to aeco)nmodate their location and use in a manner which: <br /> <br /> (a) protects the visual, aesthetic, scenic, historic, environmental and natural or man-made <br /> resources of the Town; <br /> <br /> (b) encourages the use of existing structures and towers; <br /> <br /> (c) protects property values; <br /> <br /> (d) minimizes the total number and height of towers located withi~ the community by <br /> requiring tower sharing and clustering of personal wireless communication facilities <br /> where possible; <br /> (e) minimizes any adverse impacts on the residents of the Town (such ~, but not limited <br /> to, visual blight on viewsheds, attractive nuisance, noise and falling objects) with <br /> regard to thc general safety, wclfare and quality of life in the community: <br /> <br /> (/) provides stand~rds and requirements for regulation, placement, construction, <br /> monitoring, design, modification and removal of personal wireless communication <br /> facilities; and <br /> <br /> 64 <br /> <br /> <br />
