Roots shall be severed cleanly, perpendicular to the <br />long axis of the root and cut ends immediately covered with wet burlap or <br />loam. <br />b) Exposed roots of trees to be preserved shall be covered with burlap, mulch or <br />backfill and kept damp if not backfilled before the end of the working day. <br />c) Burlap wrap shall be removed after construction work is -completed, prior to <br />final backfill. Exposed roots shall be permanently backfilled as soon as <br />possible. <br />it. Within the Critical Root Zone, boring or tunneling for utilities installation at a depth of <br />30 inches or greater is allowed. Access pits shall be located outside the Critical Root <br />Zone. <br />12. If trees have been irrigated prior to the project, they shall be watered throughout the <br />duration of construction, if there is less than one inch of rainfall per week, at the rate of <br />one inch of water over the undisturbed Critical Root Zone area per week. <br />13. Any changes or additions to the approved plans that affect the trees to be preserved shall <br />be given to the Urban Forester for review and approval. If subsequent design changes <br />are required that may impact trees to be preserved, the Urban Forester may revoke <br />approval of, or require revisions to approved tree protection plans and notes. <br />14. The Project Arborist shall identify any tree that sustains damage to more than 30% of its <br />Critical Root Zone as a result of construction. Any tree that sustains damage to more <br />than 30% of the Critical Root Zone may be considered a technical felling, and revised <br />plans, additional permit approvals, payment of appraised tree values and penalty <br />payments may be required. <br />15. The Project Arborist shall identify any tree that is made unsafe or unstable as a result of <br />construction activities (especially when excavation has occurred within an area 2-5 <br />times the dbh of the tree), and shall submit an evaluation of the safety of the tree to the <br />Urban Forester. Any tree that is determined by the Urban Forester to be unsafe shall be <br />removed or otherwise abated by the contractor per the requirements of the Urban <br />Forester. <br />16. Damages and Losses: Damage to or loss of trees identified for preservation in this <br />permit may result in the City of Eugene requiring payment of the appraised casualty loss <br />for damages, or, in the case of total tree loss, assessing administrative civil penalties up <br />to a maximum of $2,000.00 per tree, , payment of the appraised value of the trees, fines <br />of up to $4000 per tree and potential citations to municipal court with a fine of a <br />minimum of $100.00 to a maximum of $4,000.000 for each tree removed, or <br />confinement in jail not to exceed 100 days, or both fine and imprisonment(EC 6.300- <br />6.330; 6.990; R-6.305). <br />
