4.11 OTHER PERMITS <br />The applicant (Owner/Developer) is responsible for obtaining all other permits necessary to <br />complete the survey, design, and construction work. Depending on the type of work to be <br />performed and existing conditions, one or more of the following permits may be required: <br />A. Erosion Prevention Permit <br />If the Contractor's work will disturb one acre or more of land, or, regardless of the size of <br />the area impacted, if the work is located in a "sensitive area" (as defined by Administrative <br />Rule 6.645 and includes open systems to be constructed), an Erosion Prevention Permit <br />must be approved before PEPI permit issuance. If the work will disturb one or more acres <br />but less than five the construction activity will automatically be covered under a National <br />Pollutant Discharge Elimination System (NPDES) 1200 -CN permit. An NPDES 1200-C <br />permit is required for work disturbing an area larger than five acres in size. <br />B. Floodplain Development Permit <br />A Floodplain Development Permit is required prior to any development occurring within <br />the Special Flood Hazard. Area (SFHA). The SFHA includes Zones A, AE, AO and the <br />Floodway for our community on the adopted Flood Insurance Rate Map (FIRM). The FIRM <br />was created by the Federal Emergency Management Agency (FEMA) as part of the <br />National Flood Insurance Program. Development includes any man -made -change (e.g., <br />building, filling, excavating, grading, paving, etc.) within the regulatory floodplain. <br />Floodplain Development Permits are obtained at the Permit and Information Center. See <br />Appendix B for permit requirements. SFHA must also be shown on the CSMP as noted in <br />Section 3. <br />C. Wetland Permit <br />If wetland indicators are present, such as wetland plants, hydric soils or saturated <br />conditions, the applicant shall submit a wetland delineation that has received <br />concurrence from Division of State Lands (DSL). If public improvements are shown within <br />wetlands, a fill permit is required prior to PEP[ permit issuance. A Corps of Engineers <br />permit is required for disturbance of any jurisdictional wetland. A joint Corps of <br />Engineers/Division of State Lands #404 permit is required for excavation or embankment <br />of 50 cubic yards or more of material within "waters of the State."
