ATTACHMENT A <br />Section 19. <br /> Subsection (1) of Section 7.307 of the Eugene Code, 1971, is <br />amended to provide: <br />7.307 Public Way Construction and Use - Repair <br />. <br />(1) <br /> Except where waived by the city engineer, the permittee shall <br />temporarily patch with asphalt material any backfilled trench in any <br />vehicle, bicycle, or pedestrian travel [traffic] lane the same day of <br />trench backfill, until the final pavement repair is placed. Temporary <br />trench repair shall be maintained sufficiently to prevent settlement or <br />irregular surface. Temporary trench repairs in pedestrian areas <br />shall not impede the safe and accessible travel for individuals with <br />disabilities under the American with Disabilities Act. Within 60 <br />days of completion of the work and at permittee's expense the <br />permanent pavement repair of the public way to city standards shall be <br />done by a qualified contractor or by the permittee if the city engineer <br />has determined the permittee has the resources and trained personnel. <br />If the permittee fails to make the permanent pavement repair within the <br />time specified, the city may make the repair and charge the cost thereof <br />to the permittee without prior notification. <br /> <br /> <br />Section 20. <br /> A heading and new Section 7.350 is added to the Eugene Code, <br />1971, to provide: <br />PUBLIC EASEMENT REQUIREMENTS <br />7.350 Easements - Standards. Public utility easements shall be provided for <br />all city-maintained facilities. Property owners served, or to be served <br />by a utility within a public utility easement shall have access to the <br />public utility easement to construct, install, maintain, and repair private <br />utility services. <br /> <br /> <br />Section 21. <br /> Section 7.360 of the Eugene Code, 1971, is amended to provide: <br />7.360 Sidewalks - Standards <br />. All sidewalks shall be built in accordance with city <br />specifications and built to grades and alignments [established] approved by <br />the city engineer. <br /> <br /> <br />Section 22. <br /> A new section 7.365 is added to the Eugene Code, 1971, to <br />provide: <br />Ordinance - <br />17 <br /> <br />
