ATTACHMENT A <br />7.365 Americans with Disability Act (ADA) Ramp Standards. Sidewalk <br />construction shall provide an accessible pedestrian circulation system <br />that includes access ramps for street crossings compliant with Title II <br />of the Americans with Disability Act and in accordance with city <br />specifications established by the city engineer. <br />(a) Applications for privately engineered public improvements shall <br />include the design and construction of ADA access ramps within <br />and adjacent to the development site. <br />(b) The developer shall either complete the construction of the ADA <br />access ramps prior to placing the project on warranty or enter into <br />an agreement with the city and deposit funds with the city <br />engineer to cover the cost of construction and inspection, plus <br />contingency, of the ramps within the time limit established by the <br />city engineer. If the ramps are not constructed during the <br />warranty period, the city engineer may draw on these funds to <br />complete the work. <br />(c) Property owners of corner lots and lots perpendicular to and <br />facing t-intersections shall construct ADA access ramps as part of <br />their sidewalk construction. <br /> <br /> <br />Section 23. <br /> Section 7.370 of the Eugene Code, 1971, is amended to provide: <br />7.370 Sidewalks - Owners to Fill Ground Between Curb and Sidewalk <br />. It shall <br />be the duty of all property owners to fill and maintain with earth, soil, brick, <br />gravel, clay, loam, cinders, mulching material or Portland cement concrete, <br />but not asphaltic concrete, the space between the curb and sidewalk in front <br />of their property and to the curb line of the street at the intersections to a <br />level and grade with the curb and sidewalk unless an approved stormwater <br />facility is constructed between the curb and sidewalk. Subject to <br />sections 4.832 and 4.833 of this code, and sections 7.635 to 7.650, a ground <br />cover or tree may be used[ provided it is approved in writing by the city <br />manager or the manager's designee]. <br /> <br /> <br />Section 24. <br /> Subsections (1) and (2) of Section 7.385 of the Eugene Code, 1971 <br />are amended to provide: <br />7.385 Building Construction - Sidewalk and Driveway Approach Permit <br />Required <br />. <br />(1) <br /> Concurrent with the issuance of a building permit for the construction of <br />a [dwelling or business] structure or an addition to a [dwelling or <br />business] structure, the owner, builder or contractor to whom the <br />building permit is issued shall obtain a sidewalk and driveway approach <br />construction permit for the construction of a sidewalk within the <br />Ordinance - <br />18 <br /> <br />
