<br />by the permittee if the city engineer has determined the permittee has <br />the resources and trained personnel. If the permittee fails to make the <br />permanent pavement repair within the time specified, the city may make <br />the repair and charge the cost thereof to the permittee without prior <br />notification. <br /> <br />Section 20. A heading and new Section 7.350 is added to the Eugene Code, <br /> <br />1971, to provide: <br /> <br />PUBLIC EASEMENT REQUIREMENTS <br /> <br />7.350 Easements - Standards. Public utility easements shall be provided for all <br />city-maintained facilities. Sidewalk <br />construction shall provide an accessible pedestrian circulation system that <br />includes access ramps for street crossings compliant with Title II of the <br />Americans with Disability Act and in accordance with city specifications <br />established by the city engineer. <br />(a) Applications for privately engineered public improvements shall include <br />the design and construction of ADA access ramps within and adjacent <br />to the development site. <br />(b) The developer shall either complete the construction of the ADA access <br />ramps prior to placing the project on warranty or enter into an <br />agreement with the city and deposit funds with the city engineer to <br />cover the cost of construction and inspection, plus contingency, of the <br />ramps within the time limit established by the city engineer.
