<br />intersections shall construct ADA access ramps as part of their <br />sidewalk construction. <br /> <br />Section 23. Section 7.370 of the Eugene Code, 1971, is amended to provide: <br /> <br />7.370 Sidewalks - Owners to Fill Ground Between Curb and Sidewalk. It shall <br />be the duty of all property owners to fill and maintain with earth, soil, brick, <br />gravel, clay, loam, cinders, mulching material or Portland cement concrete, <br />but not asphaltic concrete, the space between the curb and sidewalk in front <br />of their property and to the curb line of the street at the intersections to a <br />level and grade with the curb and sidewalk unless an approved stormwater <br />facility is constructed between the curb and sidewalk. Subject to sections <br />4.832 and 4.833 of this code, and sections 7.635 to 7.650, a ground cover or <br />tree may be used. <br /> <br />Section 24. Subsections (1) and (2) of Section 7.385 of the Eugene Code, 1971 <br /> <br />are amended to provide: <br /> <br />7.385 BuildinQ Construction - Sidewalk and Driveway Approach Permit <br />ReQuired. <br />(1) Concurrent with the issuance of a building permit for the construction of <br />a structure or an addition to a structure, the owner, builder or contractor <br />to whom the building permit is issued shall obtain a sidewalk and <br />driveway approach construction permit for the construction of a <br />sidewalk within the dedicated right-of-way for the full frontage in which a <br />sidewalk in good repair does not exist and for the construction of <br />driveway approaches at approved curb cuts. The sidewalk construction <br />shall be completed within the building construction period or within one <br />year after the sidewalk and driveway approach construction permit is <br />issued, whichever is the lesser. <br />(2) Sidewalk construction shall be exempted from the requirements of this <br />section for building permits for: <br />(a) Construction adjacent to streets that have not been improved to <br />city street standards. <br />(b) Additions or alterations of single-family dwelling units and <br />duplexes. <br />(c) All other structures, additions or alterations in which sidewalk <br />construction costs would exceed 100/0 of the value of the proposed <br />construction. <br /> <br />Section 25.
