PUBLIC HEARING AND ACTION: An Ordinance Repealing Ordinance No. 20384 Concerning <br />Motor Vehicle Fuel Dealer’s Licenses; Declaring an Emergency; and Providing for an Immediate <br />Effective Date <br /> <br />Ms. Bettman questioned why it was necessary for the council to waive the charter-imposed, ten-day public <br />announcement period. She acknowledged the emergency provision that existed in the charter to make action <br />possible, but the council was not facing any deadlines. City Attorney Glenn Klein recalled that the council <br />agreed to repeal the ordinance that had been referred and directed the manager to return with an ordinance <br />that repealed the sunset provision and referred the three-cent increase to the ballot. The first step necessary <br />was repeal of the adopted ordinance, and staff was requesting action today rather than in September because <br />with there were legal issues surrounding the timing of the certification of signatures and future council <br />related to the ordinance. If the council wished to place something on the November ballot, it had to act <br />today on the second item on the agenda. <br /> <br />City Recorder Mary Feldman confirmed that August 15 was the last day for the council to refer an item to <br />the ballot. <br /> <br />Ms. Ortiz arrived. <br /> <br />Mr. Klein reviewed the order of the proceedings to occur. <br /> <br />Mr. Pryor, seconded by Ms. Ortiz, moved that, with the unanimous consent of the council, <br />to hold the public hearing at this time based on the individual notice provided to the attorney <br />for the gas station owners and the media notice. The motion passed unanimously, 8:0. <br /> <br />Mayor Piercy opened the public hearing. <br /> <br />Ron Tyree <br />, 4000 Spring Boulevard, owner of Tyree Oil and a participant in the effort to refer the council’s <br />decision to raise the fuel tax to the voters, termed the action the council was contemplating with regard to the <br />fuel tax outrageous. He said the council was refusing to allow the voters to consider the entire five-cent <br />increase and instead proposed to repeal the original ordinance, replace it with a new ordinance raising the <br /> <br /> <br />MINUTES—Eugene City Council August 15, 2007 Page 1 <br /> Work Session <br /> <br />
