<br />tenants continues after issuance of the condominium conversion permit by the City, until <br />the time of the first sale of a converted dwelling unit. <br /> <br />R-1078-B Application for Condominium Conversion Permit. <br /> <br />1. Time to Apply and Fee. After 30 days from delivery of the notice of <br />planned condominium conversion to the City, but no later than 60 days from that time, a <br />developer, or his or her agent, may apply for a condominium conversion permit. An <br />application for a condominium conversion permit shall be on a form as is attached to <br />this Rule as Exhibit 5 and shall be accompanied by a fee established by the City <br />Manager. <br /> <br />2. Contents. The application for a condominium conversion permit must <br />conform to the requirements of EC 2.1070 and shall also include a common elements <br />report, a rental history report, and proof of funding of a cash reserve account as <br />required by Rule R-1078-E-3. and any filed or executed condominium conversion <br />instruments. <br /> <br />3. Posting. Within two days of filing an application with the City, the <br />complete permit application, including attachments shall be posted in a conspicuous <br />place in the building or buildings to be converted and any common buildings or facilities. <br />The posting shall be maintained until the permit is allowed or denied. <br /> <br />4. Applicant's Affidavit. The applicant's affidavit shall conform to the <br />requirements of EC 2.1 070(b), (notification to tenants and neighborhood groups, <br />maintenance of receipts from affected tenants of the notice and proposed tenant <br />assistance plan contract, provision of City informational brochure, lack of eviction of <br />affected tenants). In addition, it shall disclose the place within the City where signed <br />receipts from affected tenants are kept, which shall be maintained for a period of three <br />years. Example affidavits are attached to this Rule as Exhibit 6. <br /> <br />5. Required Instruments. The instruments required to be filed with the <br />application include any document then in. existence that is required to be filed or <br />executed by state law as part of the condominium conversion or management process. <br /> <br />R-1078-C Tenant Survey Report. <br /> <br />The tenant survey report obligation shall be satisfied by filing an affidavit with the <br />City in accordance with R-1078-8-4, above. The affidavit shall attest that the applicant <br />has provided the questionnaire attached to these Rules as Exhibit 7, to each tenant with <br />an envelope, postage prepaid, addressed to the City of Eugene. The questionnaire <br />shall direct the tenant to return the completed form directly to the City of Eugene. <br /> <br />Administrative Order - Page 3 <br />
