<br />Refinement Plan Amendments (RA 07-1) <br /> <br />The proposed amendment would amend the RRSC land use diagram to change approximately 7.3 <br />acres of the site north of Green Lane from a designation of Government and Education to a <br />designation of Commercial; to change 1.3 acres of the site south of Green Lane from a designation <br />of Commercial to a designation of Medium Density Residential; and to amend the refi.nement plan <br />text to include site specific development requirements. <br /> <br />EC 9.8424 requires that the following criteria (in bold and italic) be applied to a Refinement Plan <br />amendment. <br /> <br />(l)(a) The refinement plan amendment is consistent with tlte Statewide planning goal~. <br /> <br />The findings under EC 9.7730(3)( a), above. are incorporated herein by reference. <br /> <br />(l)(b) Tlte refinement plan amendment is consistent with the applicable provisions of the ~Metro <br />Plan. <br /> <br />Applicable provisions of the Metro Plan are evaluated under EC 9.7730(3)(b), above with respect to <br />the proposed refinement plan amendments and Metro Plan amendment. The proposed refinement <br />plan amendments are not consistent with all applicable policies contained in the Residential Land <br />Use and Housing Element and Economic Element of the Metro Plan. . <br /> <br />In the event that the Planning Commission finds that the proposal is consistent with the Metro Plan <br />policies, the proposed refinement plan land use diagram amendment from Government and <br />Education to Commercial, and from Commercial to Medium Density Residential, is consistent with <br />the proposed Metro Plan land use diagram amendments from Low Density Residential to <br />Commercial, and from Commercial to Medium Density Residential. <br /> <br />(l)(c) Tlte refinement plan amendment is consistent with tlte remailting portions of the <br />refinement plan. <br /> <br />The (RRSC) land use diagram amendment to re-designate approximately 7.3 acres of the site north <br />of Green Lane from a designation of Government and Education to a designation of Commercial, to <br />re-designate 1.3 acres of the site south of Green Lane from a designation of Commercial to Medium <br />Density Residential and text amendments to limit the use of the site for commercial and residential <br />uses in a (horizontal) "mixed use center" are determined to be inconsistent \\lith remaining portions <br />of the refinement plan. <br /> <br />The applicant provided detailed findings regarding how the RRSC text and diagram amendments <br />are consistent with the policy direction contained in the RRSC. Those policies found to be <br />applicable to this request are addressed below, along with other policies specifically raised by <br />participants. Although the applicant addressed additional RRSC policies and text than those listed <br />below, they are not directly relevant to the amendments or do not constitute mandatory approval <br />criteria with respect to the proposal. <br /> <br />Staff Findings - October 8, 2007 <br />Page 18 <br />
