<br />tlte specific zone in: <br />(a) EC 9.2150 Commercial Zone Siting Requirements. <br />(/) EC 9.2735 Residential Zone Siting Requirements. <br /> <br />For this proposed zone change, there are no applicable siting requirements as referenced in the <br />above criterion. Specifically, the commercial zone siting requirements at EC 9.2150 only affect <br />properties proposed for C-l Neighborhood Commercial or C-4 Commercial/Industrial zoning. The <br />residential zone siting requirements of EC 9.2735 only affect properties proposed for R 1.5 <br />Rowhouse zoning. <br /> <br />(5) In cases where the NR zone is applied based on EC 9.2510(3), the property owner sltall <br />enter into a contractual arrangement H-'itlt the city to ensure tlte af(!a is maintained as a <br />natural resource area for a minimum of 50 years. <br /> <br />The above criterion is not applicable in this instance, as the proposed zone change does not include <br />application of the NR Natural Resource zone. <br /> <br />Recommendation: Based on the available information and materials in the record, and the above <br />preliminary findings, staff finds that the proposal does not comply with the applicable approval <br />criteria, specifically with regard to Statewide Planning Goals. the Metro Plan, and the River Road~ <br />Santa Clara Urban Facilities Plan. If no further evidence is provided to the Planning Commission <br />that demonstrates consistency with these criteria, the Planning Commission should recommend <br />denial of the applicant's proposal to City Council. <br /> <br />In the event that the Planning Commission makes positive findings that the proposed amendments <br />and zone change comply with the applicable approval criteria, statT recommends imposition of the <br />following conditions of approval: <br /> <br />1. The applicant shall record in the Oftice of the Lane County Clerk restrictive covenants on <br />the real property that is the subject of the proposed amendments, in a forn1 acceptable to the <br />City Attorney, stipulating that any future development approval for the site shall require. by <br />the time of development, full and complete construction of an additional westbound <br />approach lane on Hunsaker Lane and an additional westbound approach lane on Green Lane. <br />The restrictive covenants shall be binding on any successive owner(s) of the property, are <br />enforceable by the City of Eugene any may be amended only with the express "'Titten <br />consent of the City of Eugene. <br />2. The proposed text amendments shall be revised as follows: <br />. Regarding proposed Recommendation No.5: <br /> <br />To clarify that abutting properties not included in this application are not subject to this <br />amendment, revise the first sentence to state: "Nothwithstanding Recommendation No.4, <br />development sites abutting south of Green Lane and generally west of the eastern boundary <br />of the former Santa Clara Elementary School Site..." <br /> <br />.
