CRITERIA AND FINDINGS <br /> <br />Eugene Code Section 9.8865 requires an evaluation of any zone change application to determine <br />whether the requested change in zoning is consistent with the foHowing criteria shown in bold <br />face and italicized text. <br /> <br />EC 9.8865(1) Tlte proposed cltange is consistent with applicable provisions of tlte Metro Plan. <br />The written text of the Metro Plan shall take precedence over tlte ~Jetro Plan diagram where <br />apparent conflicts or inconsistencies exist. <br /> <br />Response: <br />The adopted Metro Plan "Land Use Diagram" designates the property as Low Density <br />Residential north of Green Lane and Commercial south of Green Lane. A metro plan diagram <br />amendment changing that desigilation to Commercial, for the entire portion of the subject site <br />north of Green Lane, and Medium Density Residential. for the portion of the subject site south of <br />Green Lane, is tmder concurrent review \vith this zone change application (see Exhibits D.1 and <br />D.2 for the existing and proposed Metro Plan designations). If the concurrent amendment to the <br />Metro Plan diagram changing the designations of the property is approved, the proposed zone <br />change will be consistent with and implement the l\1etro Plan "Land Use Diagranl." <br /> <br />Regarding conformance of the proposed zone change to the \vritten text of the Aletro Plan, the <br />applicant's responses follow: <br /> <br />Growth Management <br />l\1etro Plan, Policy 1. The UGB and sequential development shall continue to be implemented as <br />an essential means to achieve compact urban growth. The provision of all urban services shall <br />be concentrated inside the UGB. <br /> <br />Response: <br />As detailed in the response to Statewide Goal 11 (above) urban services are available to the <br />subject property and the property is within the Eugene portion of the metropolitan UGB and <br />within the incorporated City limits. As such, the subject property is providing for compact urban <br />growth and has the essential services available for development.
