<br />EC9.8865(5) In cases where the NR zone is applied based 011 EC 9.2510(3), the property <br />owner shall enter into a contractual arrangement with the city to ensure the area is <br />maintained as a natural reliource area for a minimum of 50 years. <br /> <br />Response: <br />The NR zone is not requested. Therefore, the above criterion is n'Ot applicable. <br /> <br />Statewide Planning Goals: <br /> <br />If the c'Oncurrent A1e/ro Plan and River Road/Santa Clara Urban Facilities Plan land use <br />diagram designations were already approved and acknowledged, it would not be necessary to <br />demonstrate compliance with the statewide planning goals. However, in Roloff v. City ofA1ilton- <br />Freewater, 27 Or LUBA 256 (1994), the Land Use Board of Appeals ruled that where a propelty <br />is the subject of a concurrent comprehensive plan map amendment and zone change, the zone <br />change is made under an unacknowledged plan amendment and must comply \-vith those <br />statewide planning goals applicable to the unacknowledged plan amendment. Because the <br />Statewide Planning Goals and related statutes typically address amendments t'O comprehensive <br />plans, the findings herein regarding those goals frequently refer to the pr'OPosed zone change as <br />the proposed "amendment." This is done for better comprehension and to recognize that state <br />documents often refer to "z'One map amendments" when discussing the action referred to in the <br />Eugene Code as simply a "zone change." Regarding compliance of the proposed zone change <br />(amendment) with statewide planning goals, the applicant's responses follow: <br /> <br />Goal 1 - Citizen lnvo/vemellt: To develop a citizen involvement program that insures the <br />opportunityforcilizens to be involved in all phases of the planning process. <br /> <br />Response: <br />The City of Eugene has an acknowledged citizen involvement program and an acknowledged <br />process expressed in the Eugene Code for securing citizen input on all proposed plan <br />amendments. It insures the 'Opportunity for citizens to be involved in aU phases.ofthe planning <br />process and sets out requirements for such involvement. The amendments proposed d'O not <br />amend the acknowledged citizen involvement program. The process for adopting these <br />amendments complies with the requirements of the citizen involvement provisions. <br /> <br />The Metr'O Plan contains an ackn'Owledged citizen inv'Olvement program satisfying Goall. The <br />citi:l,Cn involvement program is in Metro Plan Chapter III, pp. III-K-l to III-K-4. The proposed <br />amendments comply with and do not affect or amend the citizen involvement element in the <br />Metro Plan. <br /> <br />The proposed Refinement Plan amendment is subject to the public notification and public <br />hearing processes provided for all Type IV application procedures as stipulated in EC 9.7400 <br />through Ee 9.7455, which, along with the remainder of the Code and \vith Statewide Goals and <br />state statutes, provide the provisions for citizen involvement. <br /> <br />The City's acknowledged progranl for citizen involvement, including public notice, public <br />hearings at the level of the planning commission and city council, notificati'On of decision and <br />notification of the right of appeal, provides citizens the opportunity to review and make <br /> <br />Santa Clara - Zone Change Application <br />Written Statement - August 2, 2007 <br /> <br />Page 27 of 41 <br />
