To <br />summarize further, analysis under OAR 660-009-001 0(4) used to be triggered if the proposed amendment <br />would add or remove more than 2 aces of the commercial land supply, as stated on page 4 of the staff <br />recommendation (page 7 of the agenda packet). Now, OAR 660-009-0010(4) has been revised so that the <br />analysis required under subsection (4) is only triggered if the proposed amendment will fe-designate land <br />in excess of two acres "from an industrial use designation to a non-industrial use designation, or an other <br />employment use designation to any other use designation" (emphasis added). The 1.3 acres of the subject <br />property south of Green Lane is currently designated as an "other employment use. designation" of <br />Commercial. However, 1.3 acres is less than 2 acres, therefore OAR 660-009-00 I 0(4) is not applicable. <br /> <br />The findings for Goal 9 include analysis of the Eugene Commercial Lands Study (ECLS). Due to revision <br />of OAR 660-009-0010(4), as stated above, analysis of the ECLS is not required to address Goal 9. <br />However, the EeLS was adopted as a refinement of the Metro Plan (Ordinance No. 19852) and is <br />therefore still relevant in the context oftheapproval criteria. Spedfically, the analysis of the ECLS is <br />relevant under the Metro Plan approval criteria EC 9.7730(3)(b), regarding whether the proposed <br />amendments will make the Metro Plan internally inconsistent. Therefore, the following represents <br />relocation of the ECLS findings from EC 9.7730(3Xa) regarding Goal 9 to EC 9.7730(3)(b), and as a <br />result, a revised recommendation: <br /> <br />EC 9.7730(3)(a) Regarding Statewide Planning Goal 9: <br />Replace the findings beginning on page 4 of the staff recommendation (page 7 of the agenda packet). The <br />following text replaces the findings for Goal 9 in their entirety: <br /> <br />Goal 9 - Economic Development: To provide adequate opportunities throughout the state for a <br />variety of economic activities vital to the health, welfare, and prosperity of Oregon's citizens. <br /> <br />The Administrative Rule for Statewide Planning Goal 9 (OAR 660 Division 9) requires that the <br />City "[p]rovide for at least an adequate supply of sites of suitable sizes, types, location, and <br />service levels for a variety of industrial and commercial uses consistent with plan policies[.]" <br />Among other things, the rule requires that cities complete an "Economic Opportunities Analysis." <br />OAR 660-009-0015. Based on the Economic Opportunities Analysis, cities are to prepare <br />Industrial and Commercial Development Policies. OAR 660-009-0020. Finally OAR 660-009- <br />
