<br />“LEED R” <br />1.27 means the Leadership in Energy and Environmental <br />EQUIREMENTS <br />Design and all other green building standards required by Agency to be obtained or <br />incorporated by Beam for and into the Project. <br /> <br />“L” <br />1.28 means, collectively, the Earnest Money Loan, the Acquisition Loan and <br />OANS <br />the Centre Court/Vacant Lot Construction Loan. <br /> <br />“LD” <br />1.29 means the promissory note(s), loan agreement(s), trust <br />OAN OCUMENTS <br />deed(s), financing statement(s) and other documents issued by Agency or City and <br />executed by the Parties or delivered in connection with the Loans. <br /> <br />“M” <br />1.30 means a mortgage or deed of trust against the Property, or any <br />ORTGAGE <br />portion thereof, recorded in the real property records of Lane County, Oregon. <br /> <br />“M” <br />1.31 means the holder of any Mortgage encumbering the Property, or <br />ORTGAGEE <br />any portion thereof, together with any successor or assignee of such holder. <br /> <br />“NCB” <br />1.32 means the new building to be constructed on <br />EWLY ONSTRUCTED UILDING <br />the Centre Court/Vacant Lot Property, generally consisting of five (5) above-grade floors <br />and one (1) below grade floor of underground parking, and mirroring, in height and size, <br />the Centre Court Building. <br /> <br />“NT” <br />1.33 has the meaning set forth in Section 14.1.1. <br />OTICE OF ERMINATION <br /> <br />“PE” <br />1.34 means standard exceptions to title under a <br />ERMITTED NCUMBRANCES <br />standard title policy, including encumbrances for taxes and assessments not yet due and <br />payable, and those other liens, encumbrances and exceptions to title shown on the Title <br />Report and not objected to by Buyer within the time and in the manner described in <br />Section 5. <br /> <br />“P” <br />1.35 means the Urban Renewal Plan for the Downtown Urban Renewal <br />LAN <br />District, adopted by the Eugene City Council during July 1968, and amended thereafter <br />from time to time. <br /> <br />“PP” <br />1.36 means that certain real property, located within the City <br />ORTLAND ROPERTY <br />Exhibit E-3 <br />of Portland, more particularly described in . <br /> <br />“P” <br />1.37 means Beam’s acquisition of the Property and redevelopment of the <br />ROJECT <br />Centre Court/Vacant Lot Property. Beam’s redevelopment of the Centre Court/Vacant <br />Lot Property includes the construction of the Newly Constructed Building, the <br />rehabilitation of the existing Centre Court Building and all other improvements made to <br />the Centre Court/Vacant Lot Property. The Newly Constructed Building will be designed <br />for retail ground floor use, with office space on the remaining four (4) floors. The <br />existing Centre Court Building will be designed for retail space on the ground floor and <br />office space on the remaining four (4) floors.
