2. PUBLIC HEARING: An Ordinance Concerning Solid Fuel Space Heating Devices, and
Amending Section 6.250 of the Eugene Code, 2971.

City Manager Pro Tem, Angel Jones, said relevant information was included in the agenda packet and Ms.
Taylor might have additional information to offer.

Ms. Taylor said the ordinance had been requested by the Lane Regional Air Protection Agency (LRAPA) to
revise the Eugene Code to comply with new Federal guidelines for air quality.

Ms. Taylor, seconded by Mr. Pryor, moved to adopt Council Bill 4961, an ordi-
nance concerning solid fuel space heating devices.

Mr. Clark asked if the ordinance would apply to fireplaces as well as woodstoves. Ms. Taylor said that it
would.

Mr. Clark understood that the ordinance would lower the acceptable particulate matter by almost half and
double the number of red and yellow days. Ms. Taylor agreed it would create more red and yellow days.
She pointed out it was only advisory.

Mr. Clark noted that a violation of a red day could carry a fine of up to $500. He was not comfortable
voting for the ordinance until he had more clarity on the issue of fireplaces and fines.

Ms. Taylor withdrew her motion.

The meeting adjourned at 8:35 p.m.

Respectfully submitted,

Angel Jones
City Manager Pro Tem

(Recorded by Lynn Taylor)

MINUTES—Eugene City Council November 19, 2007 Page 5
Public Hearing
