section, "approved land uses” are dwellings allowed by a residential zone <br />on existing platted lots and other uses for which conditional or final <br />approvals have been granted by the local government. For determination <br />of conflicts from proposed mining of a significant aggregate site, the local <br />government shall limit its consideration to the following: <br /> * * * <br />(B) Potential conflicts to local roads used for access and egress to <br />the mining site within one mile of the entrance to the mining site <br />unless a greater distance is necessary in order to include the <br />intersection with the nearest arterial identified in the local <br />transportation plan. Conflicts shall be determined based on clear <br />and objective standards regarding sight distances, road capacity, <br />cross section elements, horizontal and vertical alignment, and <br />similar items in the transportation plan and implementing <br />ordinances. Such standards for trucks associated with the mining <br />operation shall be equivalent to standards for other trucks of <br />equivalent size, weight, and capacity that haul other materials; <br /> <br />As part of the City Council’s deliberations on February 21, 2007, the Council made a <br />preliminary determination that the application was “adequate” for purposes of OAR 660- <br />023-0180(8) and that (if the application could be approved under other criteria) the <br />proposed expansion would not cause conflicts with local roads used for access and egress <br />to the mining site under OAR 660-023-0180(5)(b)(B). Therefore, the findings presented <br />to the Council for the April 21, 2008 work session included the findings to that effect. <br /> <br /> B. Statewide Planning Goal 12 <br /> <br />The rule implementing Statewide Planning Goal 12 provides: <br /> <br />OAR 66-012-0060(1) * * *Where an amendment to a * * * comprehensive plan * <br />* * would significantly affect an existing or planned transportation facility, the <br />local government shall put in place measures as provided in section (2) of this <br />rule to assure that allowed land uses are consistent with the identified function, <br />capacity, and performance standards (e.g. level of service, volume to capacity <br />ratio, etc.) of the facility. A plan or land use regulation amendment significantly <br />affects a transportation facility if it would: <br /> (a) Change the functional classification of an existing or planned <br />transportation facility (exclusive of correction of map errors in an adopted plan); <br /> (b) Change standards implementing a functional classification system; or <br /> (c) As measured at the end of the planning period identified in the adopted <br />transportation system plan: <br /> (A) Allow land uses or levels of development that would result in types or <br />levels of travel or access that are inconsistent with the functional classification of an <br />existing or planned transportation facility; <br /> <br />
