ADDITIONS <br /> <br />1. EC 2.1400(3) is added to clarify that the city intends to use all authority granted <br /> by the new state law. <br />2. EC 2.1405 is added to require the city manager to adopt rules that advise staff of <br /> the classes of contract that are exempt from the public contract laws under the <br /> new state law. <br />3. EC 2.1410 is added to describe the city council's duties and powers as a contract <br /> review board as set forth in the new state law. <br />4. Definitions have been added as needed to interpret the new city council <br /> regulations. Added terms include "concession agreement," %ontract price," <br /> %ontract review board," %ooperative procurement," "debarment," "disposal," <br /> "emergency," "energy savings performance contract," "findings," "invitation to <br /> bid," "offeror," "Oregon Public Contracting Code," "person," "proposal," <br /> "request for proposal," "services," %olicitation," "solicitation agent," %olicitation <br /> documents," %urplus property," and "telecommunications services." <br />5. EC 2.1425 is an expansion of EC 2.1230(3) that describes the process by which <br /> the city council, as the city's contract review board, may create special selection, <br /> evaluation and award procedures for, or may exempt from competition the award <br /> of, a specific contract or class of contracts. This section complies with new state <br /> law. <br />6. EC 2.1430 restates prior city law concerning exempt classes of contracts, with the <br /> following additions and changes: <br /> a. EC 2.1430(2)(b) and (c) are a restatement of the new state law that <br /> provides for the award of medium-sized public improvement contracts <br /> an informal quote procedure. <br /> b. EC 2.1430(2)(e) creates a new exemption from bidding that will avoid <br /> delays that would otherwise deprive the city of the opportunity to take <br /> advantage of private funding and development activities to build small <br /> public improvements at significant cost savings, if all other public <br /> contracting conditions, including the payment of prevailing wages, are <br /> met. <br /> c. EC 2.1430(4) requires the use of a formal request for proposals for <br /> hybrid contracts such as design/build and CM/GC contracts, for which <br /> selection by bid would be inappropriate, and follows the Attorney <br /> General's Model Rules of selection for energy savings performance <br /> contracts. <br /> d. EC 2.1430(6)(c) expands the exemption for police dogs to include <br /> other animals. <br /> e. EC 2.1430(6)0) exempts the sale of abandoned vehicles or other <br /> property. The treatment of abandoned property is heavily regulated by <br /> other provisions and state law and the Eugene code and this provision <br /> will allow the city manager to promulgate rules that utilize modern <br /> methods, including electronic auction. <br /> f. EC 2.1340(6)(k) is not a new exemption but clarifies that a contract <br /> may be renewed in accordance with its own renewal terms. <br /> <br /> <br />
