I <br />2 !~ 8 <br />ORD II~~ANCE NO . 8 7 58 <br />An Grdinance vacating the following described areas, to-wit: <br />' That certain portion of Franklin Boulevard in the City of Eugene <br />Lying between the wTorth line of Eighth Avenue and a line extended <br />from the intersection of the Ivxortli line of Broadway and the <br />v westerly side line of Franklin Boulevard to the intersection of <br />the Southerly line of Broadway extended easterly with the easterly <br />', side line of Franklin Boulevard. <br />That certain section of Eighth Avenue in the City of Eugene lying <br />between the westerly line of the Southern Pacific Company's right <br />of way extended across the said avenue and the westerly line of <br />Franklin Boulevard. <br />That certain section of Broadway in the City of Eugene, lying <br />~ between the westerly line of the Southern Pacific Company's <br />right of way extended across Broadway and the Westerly line of <br />Franklin Boulevard. <br />SAVING AND ExCEPTING from the vacation of Eighth Avenue and <br />Franklin Boulevard that certain section of the intersection of <br />Eighth Avenue and Franklin Boulevard lying between the revised <br />easterly right of way line of the Southern Pacific Company and <br />the existing easterly right of way line of Franklin Boulevard <br />and bounded on the north by the north line of Eighth Avenue and <br />on the south by the center line of Eighth Avenue extended easterly <br />to an intersection of the easterly right of way line of Franklin <br />Boulevard, to be used as a roadway to the adjoining property. <br />~dHEREAS, heretofore and on the 26th day of October, 1942 the Common Council <br />of the City of Eugene passed an Ordinance setting a hearing for December 14, 1942, <br />in the Council Chambers at which time and place protests and remonstrances could <br />be heard as to the vacation of the following described premises, to-wit: <br />That certain portion of Franklin Boulevard in the City of Eugene <br />~~ lying between the North line of Eighth Avenue and a line extended <br />from the intersection of the North line of Broadway and th e <br />~ ~ westerly side line of Franklin Boulevard to the intersection of <br />the Southerly line of Broadway extended easterly with the easterly <br />side line of Franklin Boulevard. <br />That certain section of ~i~ighth Avenue in the City of Eugene <br />~ lying between the westerly line of the Southern Pacific Company's <br />right of way extended across said avenue and the westerly line <br />of Franklin Boulevard. <br />That certain section of Broadway in the City of Eugene lying <br />between the westerly line of the Southern Pacific Company's <br />right of vvay extended across Broadway and the westerly line <br />of Franklin Boulevard. <br />and, <br />1~"HEi~EAS, a hearing was held pursuant to said Ordinance in the Council Chambers <br />in the City Halp in the City of Eugene on Illonday, December 14, 1942 at 7:30 o'clock <br />I'. N. of said day and at said time the Council heard all objections, at73 <br />lc.'-~~:AS, all persons ownir_g property abutting upon said areas have consented <br />~ to said vacation, it being the purpose of said vacation to enable the State <br />Highway Commission to reconstruct the entire Judkin's Point area at the Eastern <br />City Limits of the City of Eugene, and eliminate all of the railroad crossings <br />for the safety of the traveling public of the City of Eugene, and <br />V',tII~REAS, after investigation and hearing, and being fully advised, the Council <br />
