2()9 <br />finds that it is necessary that exception shall be made as to a passage-way <br />permitting ingress and egress by certain of the consenting abutting owners, <br />Now, Therefore, <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOti`JS: <br />Section 1. The Common Council of the City of Eugene finds that due and <br />legal notice of the said hearing was published and posted as required by law; <br />that no valid objeetian to said vacation has been trade at said hearing, or filed; <br />that the consents of the owners of the abutting property properly acknowledged <br />have been filed in said proceeding; and that the public interest will not be <br />prejudiced by the vacation of said areas. <br />Section 2. That said hearing was held on December 14, 1942, at 7:30 o'clock <br />in the Council Chambers of the City Hall in Eugene, Lane County, Oregon, and no <br />objections or remonstrances were made or filed. <br />Section 3. That the following described areas, to-wit: <br />That certain portion of Franklin Boulevard in the City of Eugene <br />lying between the north line of Eighth Avenue and a line extended <br />from the intersection of the North line of Broadway and the <br />~,v'esterly side line of Franklin Boulevard to the intersection of <br />`" the southerly line of Broadway extended easterly with the easterly <br />side line of Franklin Boulevard. <br />That certain section of Eighth Avenue in the City of Eugene lying <br />~- between the westerly line of the Southern Pacific Company's right <br />of way extended across said avenue and the westerly line of <br />Franklin Boulevard. <br />That certain section of Broadway in the City of Eugene lying between <br />~d the westerly line of the Southern Pacif is Company's right of way <br />extended across Broadway and the westerly line of Franklin Boulevard. <br />SAVING AND EXCEPTING from the vacation of Eighth Avenue and Franklin <br />Boulevard that certain section of the intersection of Eighth <br />Avenue and Franklin Boulevard lying between the revised easterly <br />~ rigrtt of way line of the Southern Pacific Company ahd the existing <br />easterly right of way line of Franklin Boulevard and bounded on <br />the north by the north line of Eighth Avenue and on the south by <br />the center line of Eighth Avenue extended easterly to an inter- <br />section of the easterly right of way line of Franklin Boulevard, <br />to be used as a roadway to the adjoining property. <br />be and the same is hereby vacated, and the area so vacated being streets, shall <br />revert to the abutting property pursuant to the statutes of the State of Oregon; <br />specifically reserving however, to the City of Eugene and to any of its agencies, <br />all utilities of every character in the within vacated area, with the right of <br />operating, maintaining, repairing and re-building the same. <br />Section 4.
