21~ <br /> <br /> <br />and at said time the Council heard all objections, and <br />ttiHE1tiEAS all persons owning property abutting upon said area have consented <br />to said vacation, it being the purpose of said vacation to enable the City of <br />Eugene to narrow Ramble Avenue from 50 feet to 25 feet because Ramble Avenue is <br />a dead-end street serving six owners-and it is beautified by trees and shrubbery <br />within the street which, if the street is widened must be removed, and for uses <br />for which it shall be subjected, there is no occasion for improving the full <br />vvidth of 50 feet at great expense to the City of Eugene. <br />Now, Therefore, <br />THE CITY OF EUGET~~E DOES ORDAIN AS FOLLOV'dS: <br />Section 1. The Common Council of the City of Eugene finds that due and legal <br />notice of the said hearing was published and posted as required by law; that no <br />valid objection to said vacation Ylas been made at said hearing, or filed; that the <br />consent of the owners of the abutting property, properly acknov~rledged, has been <br />filed in said proceeding; and that the public interest will not be prejudiced by <br />the vacation of said area. <br />Section 2. That said hearing w~:s held on December 28, 1942 at 7:30 o'clock <br />P. zap. in the Council Chambers of the City Hall in Eugene, Lane Oounty, Oregon, <br />and no objections or remonstrances were made or filed. <br />Section 3. That the following described areas, to-wit: <br />Beginning at the intersection of the easterly line of Fairmount <br />Boulevard and the northerly line of :amble Avenue, as laid out <br />and platted in tYie City cf Eugene running thence easterly along <br />the north line of said Ramble Avenue to the east line of ~iamble <br />Addition; thence South 12.64 feet; thence westerly 12.5 feet <br />distance from and parallel to the north line of said Ramble <br />Avenue, to the easterly line of Fairmount Boulevard, thence <br />nortr~easterly along the easterly line of Fairmount Boulevard <br />to the place of beginning. <br />Beginning at the intersection of the easterly line of ?~airmount <br />Blvd., and the Southerly line of ~Iamble Avenue as laid out and <br />platted in-the City of Eugene, running tYience easterly along the <br />Southerly line of said Harnble Avenue 173.6 feet; ti~ence north- <br />westerly 30 feet to a point 12.5 feet measured at right angles <br />to the southerly line of Ramble Avenue; thence vaesterly 12.5 <br />feet from and parallel to the south line of ?amble Avenue to the <br />easterly line of Fairmount Blvd., thence southwesterly along <br />tree easterly line of Fairmount Blvd. to the place of beginning. <br />Beginning at the intersection of the south line of Hamby Avenue <br />and the east line of Ramble Addition, as laid out and platted in <br />the City of Eugene, running thence north 12.65 feet; thence north- <br />westerly 12.5 feet distance from and parallel to the said south <br />line of IIamble 1avenue 290 feet, to the point of curve of a curve <br />having a lU foot radius; thence on the circumference of said cuazve <br />to its intersection v~iith the northerly line of the alley as platted <br />in Ramble Addition ; thence on a curve to the left having a four <br />foot radius. to its intersection vti=itYi the southerly line of said <br />Ramble l-avenue; thence easterly along the southerly line of Ramble <br />Avenue to t~~e place of beginning. <br />be and the same is hereby vacated, and the area so vacated, being a street, shall <br />revert to the abutting property pursuant to the statutes of the State of Oregon, <br />specifically reserving, ho~rdever, to the City of 'Eugene and to any of its agencies, <br />all utilities of every character in the within vacated area, with the right of <br />operating, maintaining, re paining and re-building the same. <br /> <br />
