226 <br />disclosed by the license, by mail, and shall cause a notice to be published once <br />in the Eugene Register-Guard describing dogs so impounded and notifying the owner <br />or owners to immediately call for said dog, pay the cost of impounding, procure <br />a license if the dog has none, and give the Chief of Police reasonable assurances <br />that the dog will not again run at large. ~~=hereupon the Chief of Folice shall <br />direct that the dog be released to his owner. <br />Section 7. Five days after the publication of the notice hereinabove refer <br />to, the Chief of Police is authorized to sell any impounded dog or dogs ~o ad- <br />vertized to any purchaser who will pay his license fee and the cost of impounding <br />and will give the Chief of Folicd assurances that the dog v:ill no longer be <br />permitted to run at large during the prohibited period. <br />Section 8. Ten days from the date of the publication of the notice any dogs <br />uncalled for shall be killed in a humane manner under direction of the Humane <br />Society. <br />Section 9, Any dog owner, believing himself aggrieved by the seizure and <br />impounding of his dog may apply to the City Recorder for the release of such dog <br />and the City Recorder shall thereupon set a time and place for hearing such <br />application and notify the Chief of Police and upon a summary hearing at such titre <br />and place, the City Recorder shall have full power to determine whether the dog <br />has been wrongfully impounded and v~hether he shall be returned to his owner and <br />upon what terms. <br />Section 10. Any person, firm, or corporation violating any of the provisions <br />of this ordinance shall upon conviction thereof in the Recorder's Court be fined <br />not to exceed X25.00 and the costs of the prosecution and upon default in payment <br />of the fine may be imprisioned in the City Jail one day for each y~2.00 of such <br />fine unpaid. <br />Section 11. 1~,'HEREAS~: the United States is at War and the Administration <br />had declared that the tttaintenance of Victory Gardens are essential to the national <br />preservation, and WHEREAS no whole hearted corr~pliance with the Administration's <br />policy can be had if dogs are permitted to run at large and destroy gardens, and <br />baHEF~~'AS, the time has arrived for the preparation of gardens andr_the rfore <br />an emergency is declared to exist and trte Council declares it to be necessary <br />for the peace, health and safety of the City of Eugene that this ordinance take <br />effect immediately upon its passage by the Common Council and its approval by the <br />1~~ayor, and it is so ordered. <br />Passed by the Common Council Approved by the 1V_~ayor <br />this 22nd day of March, 1943. <br />~~ % Tohn Fi P1 ds <br />City Recorder Pro Tem <br />this 23rd day of ih~arch, 1943. <br />f sf E1 i sha La,~~, <br />Mayor <br /> <br />
