That to open and establish said street, it will be necessary <br />to acquire the land as shown by said report and the City of Eugene does hereby <br />determine to acquire said land mentioned and described in said report for the <br />purpose of opening, extending and establishing said Fillmore Street from the <br />alley south of Sixth Avenue west in Eugene, Oregon. <br />Section 3. That F. N. Bennett, James A. Rodman and ~°~m. R. Robertson <br />three disinterested free-holders of the City of Eugene and each possessing the <br />qualifications of jurors of the Circuit Court of Lane County, Oregon are appoin- <br />ted as viewers to view such proposed street and made an assessment of the damages <br />and benefits as provided in Section 4 of Chapter 92 of the Charter of the City <br />of Eugene. <br />Section 4. That said viewers are directed to meet on the 4th day of <br />January, 1944 at 10 o'clock in the Council Chambers of the City Hall in the City <br />of Eugene, and the City Recorder is directed to cause a notice to property owners <br />by publication for• at least ten days successively pr~;or to the said day assigned <br />for said viewers to meet, in a newspaper published in the City of Eugene, giving <br />the names of and the time and place appointed for them to meet and specifying <br />with convenient certainty the boundaries, termini or other description of the <br />said proposed street, and the boundaries or other description of the parcels of <br />private property to be appropriated for said purpose. <br />Section 5. That the City Recorder is directed to send by mail post-pai <br />a copy of each notice to each of tree property pwners whose property is proposed <br />to be appropriated or to the agent of such owner where the postaddress address <br />of such owner or agen-t is known to him, and if such postoff ice address be unkno <br />to him, then such notice shall beddirected to such owner or agent at Eugene, <br />Oregon, as provided in Section 3 of Chapter 9 of the Charter of the City of <br />Eugene. <br />Section 6.
