<br />2'7 3 <br />ORDINAi~TCE NO 8789 <br />An Ordinance to regulate the planting and care of all trees, shrubs, <br />flowers, plants and vegetation on City property, and within the boundaries of <br />streets and alleys, and in any place controlled by the City involving traffic <br />hazards. <br />THE CITY OF EIIGENE DOES ORDA.IV AS FOLLO~~'S: <br />Section 1. Obstruction of visision at intersections. It shall be un- <br />lawful for any person, firm or corporation owning, in possession of, occupying <br />or having control of any premises within the city of Eugene, to plant, maintain <br />or allow any tree, shrub, bush, or plant of a height in excess of~three feet <br />above the crown of the adjacent roadway or to place or allow any wood to be <br />piled or other substances placed in that protion of the roadway between the <br />property line and the curb line within 25 feet from the intersection of curb <br />lines at any street, avenue or highway intersection. Where curbs have not been <br />established, no such use of the said street area shall be made within 15 feet <br />of the intersection of property. lines extended at any street, avenue, or high- <br />way intersection. The terms, "bush",tSshrub;' or "plant", as sued in this sec- <br />tion shall include clambers or other vegetation growing upon or supported by <br />poles, wires, or trellises, but the provisions of this section shall not be <br />applicable to poles, hydrants, or other facilities placed, maintained, and <br />established by any governmental agency or public or private utility. <br />Section 2. Location of shade trees in streets. All trees planted or <br />set out in the streets shall be placed on a line in the center of the space <br />between the curb and sidewalk lines. <br />Section 3. It shall be, unlawful to plant any fir, cedar, balm, poplar <br />nut, locust, fruit or cottonwood trees in arty parking strip in any street in <br />the City of Eugene. <br />Section 4. Trimming oP Trees; It shall be unlawful for any person <br />to permit the branches of any tree upon or in front of any premieses of which <br />he is the owner or occupant, to be less that nine feet above the sidewalk or <br />less than twelve feet above the roadway; provided that the clearance over the <br />sidewalk be level with that over the street and that the trees be trimmed symm- <br />etrically all around. <br />Section 5. City May Remove; All trees, shrubs, plants and iegetation <br />in any parking strip may be trimmed, pruned or removed at any time by the City. <br />or the City may require any property owner to trim, prune or remove all trees, <br />shrubs, plants or vegetation in a parking strip abuttin~ upon said owner's <br />property and Failure to comply therewith, after ten day s notice by the City <br />Recorder, shall be deemed a violation of this ordinance. <br />
