2'~ 4 <br />Section 6; Removal of Trees; Whenever in the opinion of the City <br />Engineer, the roots of any tree in the streets have entered any sewer, lateral <br />sewer, or house connection in said streets and are stopping, restricting or <br />retarding the flow of sewage therein the City Engineer shall notify the owner <br />to remove said tree. If the owner fails to remove said treet within thirty <br />days, the City, Engineer may remove said tree and assess the costs against the <br />property.. <br />Section 7: Park Committee; The provisions of this ordinance shall be <br />under the supervision of the Park Committee of the City Council, and no tree <br />shall b~e removed from streets, alleys or City property, except upon permission <br />from the Park Committee. <br />Section 8. Repeal; All ordinance-and parts of ordinances in conflict he <br />herewith are hereby repealed. <br />Section 9. Penalty; Any firm, person or corporation violating any of <br />the provisions of this ordinance, or refusing to comply with any direction upon <br />the notice aforesaid, shall upon conviction by the City Recorder, be fined, not. <br />to exceed X50.00 and costs of prosecution and may be imprisoned in the City Jail <br />one day for each X2.00 of the fine unpaid. <br />Passed by the Common Council <br />on this lst day of May, 1944 <br />/s/" John Fields <br />City Recorder pro tem <br />i <br /> <br />
