<br />ORDINANCE N0. 8803
<br />An ordinance providing; for the regulation of hotels, rooming houses and
<br />lodging houses t~yithin the City of Eugene, requiring licenses, and providing
<br />penalities and declaring an emergency.
<br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS;
<br />SECTION 1, Commencing January, first, 1943, it shall be unlavaful for
<br />•any person to conduct, keep, manage, operate; or cause to be conducted, kept,
<br />managed or operated; either as owner, lessor, lessee, agent or Attorney, any
<br />hotel, roomin house, or lidging house, within the ineprporate limits of the
<br />City of Eugene without having first obtained a license from the Council en-
<br />titling hom to do so as~provided in this ordinance. License fees shall be
<br />as follows;
<br />4 to 10 rooms - - - - - - 2.50
<br />11 to 20 rooms - - - - _ - - 5.00
<br />21 rooms or more, - - - - - 10.00
<br />and no license shall be issued for a less amount.
<br />SECTION 2. There is attached hereto rules and regulations marked
<br />Exhibit "A", which is expressly made a part hereof as though set out herein.
<br />SECTION 3. For the purposes of this ordinance, the work "person" shall
<br />mean and include matural persons, co-partnerships, corporation and associat-
<br />ions, and shall include persons of both sexes. The wor "house" shall mean
<br />and include hotels, roomir~ houses and lidging houses.
<br />SECTION 4. For the purpose of this ordinance, a hotel, rooming house
<br />or lodging house shall be and is deemed to be any house or building containing
<br />four or more rooms which are kept and maintained for sleeping or lodging
<br />purposes and which are offered to the public for rental or hire, either for
<br />steady roomers or transients.
<br />SECTION 5. No license whatever shall be granted to any applicant or to
<br />any hotel, rooming house or lodging house, except that the applicant shall be
<br />a person of good moral character, and shall be qualifoed in all respects to
<br />operate a hotel, rooming house or lodging house, and in case of having operated
<br />such a house, shall have a good record as a law abiding citizen and having
<br />operated an orderly place.; and no license shall be granted for the operation
<br />of any hotel rooming house or lodging house, which hotel, rooming house or
<br />lodging house does not conform and comply with the rules and regulations of
<br />this ordinance and the Ordinances of the City of Eugene generally and part-
<br />icularly with respect to fire hazard, theBuilding Code and sanitary regulations
<br />of the Health Department.
<br />SECTION 6. Whenever an application shall be made for a license for the
<br />operation of a hotel, rooming house, or lodging house, the Council shall re-
<br />quire reports from the Chief of the Fire Department, the Chief of Police and
<br />from the Health officer ~s to the hotel, rooming house or lodging house,
<br />complying with the rules and regulation and Ordinances, and the Chief of Police
<br />shall make a particular examination and report both as to the character of the
<br />hotel rooming house or lodging house, and of the applicant with respect to
<br />his or her police record, and if the Council shall be satisfied that the appli-
<br />cant and the hotel, rooming house or lodging house comply substantially with
<br />the foregpoing requirements, a license shall be issued, and in case they
<br />shall find that either the applicant or the hotel, rooming house or lodging
<br />house does not substantially comply with the foregong requirements, the license
<br />shall de denied; provided, howeverm that in case the applicant shall be ag~reivec
<br />at the deniel of his application, that the Council shall permit the applicant
<br />to be heard in person before the deniel shall become absolute.
<br />SECTION 7. Each license shall run during the current callendar year
<br />and shall terminate of the 31st day of Ddeember following the issuance of the
<br />license; and it is reserved to the Council the right at any time for any reason
<br />set out in ;:section 5 to revoke any license granted in the same manner as it
<br />was previously granted, and for the same reasons.
<br />SECTION ~. No license issued under the terms of this ordinance shall
<br />be transferred or assisgned without the consent of the Common Council.
<br />SECTION 9. No person to whom a license shall be issued as provided in
<br />this ordinance shall suffer or permit the hotel, rooming house or lodging house
<br />to which such license relates, to be used as a house of ill fame, brothel,
<br />bawdy house or disorderly house, for the purpose of prostitution, fornication,
<br />or lewdness, or su~'~;er any lacivious cohabitation, adultery, fornication or
<br />other immoral practice to be carried on therein, or suffer or permit any dis-
<br />orderly conduct in said hotel, roomin house or lodging house, as disorderly
<br />conduct is now and may hereafter be def fined by the OdinBnaes of the City oP
<br />Eugene.
