I <br />3~6 <br />ORDINANCE N0. 8829 <br />~i Ordinance to vacate a certair. street in the City of Eugene. <br />WHEREAS, An inspection has been had of that certain portion of Taylor street from <br />Fourteenth Avenue North to the property line of the Seventh-Day Adventist School, and it is <br />deemed by the Council that the street is of no particular value, and that it is dangerous and <br />difficult.to maintain and that it should be vacated. <br />and Whereas, the street being a public way has no City liens, no taxes, and <br />Whereas, the said proposed vacation has been submitted to and approved by the Planning <br />Commission of the City of Eugene, <br />Therefore, <br />THE CITY OF EUGEA?E DOES ORt7AIId AS FOLLOWS; <br />Section 1. The Common Council of the City of Eugene hereby initiates vacattior. pro <br />ceedings on its awn authority, without petition or consent of the property owners, except- <br />ing as provided by statute, of the following described street in the City of Eugene, to-wits <br />That portion of Taylor street from I.l~th avenue north to the property line <br />of the Seventh-Day Adventist school, <br />reserving to the City the right t o enter, construct and maintain all sewers, water pipes <br />and public utilities. <br />Section 2. A hearing shall be held upon the proposal to vacate the street, as herein <br />provided, and said hearing shall be held on the 9th day of July, 191+5, at the Council <br />Chambers of the City Hall in Eugene, Lane County, Oregon, at 7:30 otclock P.M. of said day, <br />at which time all persons will be heard upon objections or suggestions with reference to <br />the vacation of said street, and at said time the Council will provide for the said vacation. <br />of said premises or deny such vacation, and in case the vacation is made will make pro <br />visions for any damages sustained. <br />Section 3. The City Recorder be and he is hereby required to immediately publish for <br />four consecutive weeks in a newspaper published in Eugene, Lane County, Oregon, notice of <br />the proposed vacation. Such notice shall give the description of the street to be vacated <br />as hereinset out, and state the date w'rien this ordinance was passed; the name of arty petit- <br />ioners petitioning for said vacation; the date when the said petition, together with any <br />objection or remonstrances which may be made in writing and filed with the City Recorder <br />prior to the date of said hearing will be heard and considered. - <br />Section 1~. The City Pecorder shall forthwith and within five days after the first <br />publication of said notice, post or cause to be posted at or near each end of said proposed <br />vacation, a copy of the foregoing notice, which shall be headed "P~otice of Street Vacation", <br />and which notice shall be posted in at least two conspicuous places in such proposed vacation <br />area. <br />The posting acid the first day of publication of such notice shall not be less than <br />twenty-eight days bafore the time set for hearing. <br />,~ r <br />
