3~3 <br />Frank and Sarah Seal <br />Beginning at a point 2Li.7.5 feet north and 1,053.81+ feet west of the northwest corner <br />of the James Huddleston Donation Land Claim No. 37, thence west 162.92 feet to the west <br />line of Garfield Street, thence north 11.E feet, thence east 162.92 feet, thence south 11E <br />feet to.the plane of beginning; containing 2,280.$8 square feet. <br />Seotion 2. .That to open and establish said alley, it will be necessary to acquire <br />the land as shown by said report and the City of Eugene does hereby determine to acquire <br />said land mentioned and described in said report for the purpose of opening of the alley <br />between Seventh Avenue and Eighth Avenue west from west line of Hallock Addition to Gar- <br />field street, Eugene, Oregon. <br />Seotion 3. ,That William R. Robertson, James A. Rodman Sr., and F. M. Cashman,. <br />three disinterested free-holders of the City of Eugene and each possessing the quelifica- <br />tions of furors of the Circuit Court of Lane County, Oregon, are appointed as viewers to <br />view such proposed alley and make an assessment of the damages and benefits as provided <br />i.n Section,. 1.E of Chapter 92 of the Charter of the City of Eugene. <br />Section LE. That said viewers are directed to meet on the 27th day of June, 19+5 <br />at 10 o'clock A.M. in the Council Chambers of the City Hall in the City of Eugene, and the <br />City Recorder is directed to cause a notice to property owners by publication for at least <br />ten days suocessively prior to the said day assigned for said viewers to meet in a news- <br />paper published in the City of Eugene, giving the names of and the time and place appointed <br />for them to meet and specifying with convenient. certainity the boundaries, termini or other <br />description of the said proposed alley, and the boundaries or other description of the <br />parcels of private property to be appropraited for said purpose. <br />Section 5. TheCity Recorder is directed to send by mail postpaid, a copy of each <br />notice to each of the property owners whose property is proposed to be appropraited or to <br />the agent of such owner where the postoffice address of~~sueh~:owner it agent is known to <br />him, and if such postoffice address be unknown to him, then such notice be directed to <br />such owner or agent at Eugene, Oregon, as prpirided in Seotion 3 of Chapter 9 of the Charter <br />of the City of Eugene. <br />Section 6. That is is neoessary for the convenience of the citizens of the City of <br />Eugene, that said alley be opened and extended and an emergency is therefore ded3ared to <br />exist, and it ie therfore declared to be for the immediate preservation of the peace, <br />health and safety of the City of Eugene that is ordinanoe become effective immediately <br />upon its passage by.the Common Council and approval by the Mayor, <br />Approved by the Mayor this Passed by the Common Council this <br />11th day of June,. 1:9IE5. 11th day of June, 19lE5. <br />~s~ Earl L.
