3~3 Frank and Sarah Seal Beginning at a point 2Li.7.5 feet north and 1,053.81+ feet west of the northwest corner of the James Huddleston Donation Land Claim No. 37, thence west 162.92 feet to the west line of Garfield Street, thence north 11.E feet, thence east 162.92 feet, thence south 11E feet to.the plane of beginning; containing 2,280.$8 square feet. Seotion 2. .That to open and establish said alley, it will be necessary to acquire the land as shown by said report and the City of Eugene does hereby determine to acquire said land mentioned and described in said report for the purpose of opening of the alley between Seventh Avenue and Eighth Avenue west from west line of Hallock Addition to Gar- field street, Eugene, Oregon. Seotion 3. ,That William R. Robertson, James A. Rodman Sr., and F. M. Cashman,. three disinterested free-holders of the City of Eugene and each possessing the quelifica- tions of furors of the Circuit Court of Lane County, Oregon, are appointed as viewers to view such proposed alley and make an assessment of the damages and benefits as provided i.n Section,. 1.E of Chapter 92 of the Charter of the City of Eugene. Section LE. That said viewers are directed to meet on the 27th day of June, 19+5 at 10 o'clock A.M. in the Council Chambers of the City Hall in the City of Eugene, and the City Recorder is directed to cause a notice to property owners by publication for at least ten days suocessively prior to the said day assigned for said viewers to meet in a news- paper published in the City of Eugene, giving the names of and the time and place appointed for them to meet and specifying with convenient. certainity the boundaries, termini or other description of the said proposed alley, and the boundaries or other description of the parcels of private property to be appropraited for said purpose. Section 5. TheCity Recorder is directed to send by mail postpaid, a copy of each notice to each of the property owners whose property is proposed to be appropraited or to the agent of such owner where the postoffice address of~~sueh~:owner it agent is known to him, and if such postoffice address be unknown to him, then such notice be directed to such owner or agent at Eugene, Oregon, as prpirided in Seotion 3 of Chapter 9 of the Charter of the City of Eugene. Section 6. That is is neoessary for the convenience of the citizens of the City of Eugene, that said alley be opened and extended and an emergency is therefore ded3ared to exist, and it ie therfore declared to be for the immediate preservation of the peace, health and safety of the City of Eugene that is ordinanoe become effective immediately upon its passage by.the Common Council and approval by the Mayor, Approved by the Mayor this Passed by the Common Council this 11th day of June,. 1:9IE5. 11th day of June, 19lE5. ~s~ Earl L.
